NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission, <br />Mayor and City Council <br />FROM: Brad Nielsen <br />DATE: 4 January 1983 <br />RE: Smith, Gary - Landlocked Parcel <br />FILE NO: 758.09 (82.37) <br />BACKGROUND <br />Mr. Gary Smith has requested that he be allowed to build a single family <br />dwelling on property he is purchasing by contract for deed from Eugene <br />Fasciana. The property is located approximately 130 feet south of North <br />Owasso Boulevard and 132 feet east of Twin Lake Road (see Exhibit A, attached). <br />The property is currently landlocked except for a 15 foot easement to North <br />Owasso Boulevard. Since the property does not have adequate frontage on a <br />public right -of -way, it is currently considered an unbuildable lot. <br />Based upon discussions with the City Clerk and research of past Council <br />minutes and City files, we have been able to determine how several of the <br />surrounding lots were created. However, we have been unable to determine <br />when or how the lot in question was created. <br />ISSUES AND ANALYSIS <br />Exhibit A shows the location of the property in question and its relationship <br />to surrounding parcels. All of these parcels, including part of the property <br />in question, were formerly part of Lot 6, Nordstrom's Twin Lake Addition. <br />Based upon City files, parcels shown as Lots A and B were divided from Lot C <br />in 1975. As can be seen, a 30 foot strip was left to the west of Lot A, <br />presumably for future access purposes. Exhibits B, C and D indicate that a <br />subdivision for two lots just east of the Smith /Fasciana property was approved <br />in 1977. Although the subdivision was apparently never recorded, it appears <br />that the Council was concerned with access at that time. That approval <br />(Exhibit D) stated that a street with an adequate turn -around and sewer <br />improvements should be made by the developer of the lots. <br />Ideally, a 50 foot right -of -way should be provided for access to the property <br />in question, as well as for future development of Parcel C. We are not sure <br />if the Council's past approval for a substandard 30 foot street still applies <br />to the area in question. At any rate, we feel that development of the property <br />in question must not occur until adequate public access is provided. <br />4820 minnetonka boulevard, suite' -- s, mn 55416 612/925 -9420 <br />
