MINUTES
PLANNING COMMISSION
JUNE 8, 2006
Hall asked if Mr. Sedaghat had considered relocating his business.
Sedaghat reported that there is no where else to go.
Hall asked if Mr. SedaghaC was ever able Co operate under the conditions
of the CUP. Mr. Sedaghat reported that he has tried his best. Sedaghat
reported that his wife had been involved, so there are details he is not sure
of. He again questioned how the City can limit the number of vehicles
under his Auto Repair License.
Hall questioned the ownership of the cars at Valor Enterprises. Mr.
Sedaghat reported that most vehicles are owned by individual customers
who have brought the cars to his business for repair. Again, many are
sitting waiting for parts or for an employee who can do the repairs.
SedaghaC also reported that he may buy a car that needs a new motor and it
sits at the lot until he can find a motor.
Knudsen pointed out that Little Canada works hard to try to create a
climate that is favorable to both residents and businesses. In this case,
there was agreement on the conditions of a CUP that was issued, and the
City has been patient in trying to find ways to work with the property
owner for the past seven years. Knudsen felt Che issue was at an impasse
at this poinC, and felt extending the timeframe for compliance would not
be a prudent thing to do.
Rheaume asked what a reasonable date might be if the City gave Valor
additional tithe for compliance. The City Planner noted that licenses
expire on June 30'h, and the City Council's last meeting in June is June
28'h.
Sedaghat asked what he could do on his property if the CUP's are
revoked. Knudsen suggested that a transitional use might be appropriate,
buC noted that the vehicles would have to be removed from Che property.
SedaghaC reported Chat he had no place Co move Chese vehicles. Sedaghat
asked for one final chance to get his property into compliance. It was
noted that Sedaghat has made this same request in the past. Knudsen
stated that the most prudent thing for Che Council to do at this point is to
revoke the license.
Knudsen recommended revocation of the Conditional Use Permits for auto
retail sales and for open and outdoor storage issued to Valor Enterprises at
3161, 3165, and 3167 Spruce Street as recommended by City staff and for
the reasons as outlined in staff's report dated June 1, 2006.
Motion seconded by McGraw.
IS
