At this point, I believe it is safe to say <br />that a decision on the matter is open to question. <br />While I realize the courts will have to determine the legality of existing or <br />past conversions, I believe the City should secure its future position on a <br />more sound basis. What I am suggesting is that condominium conversions be <br />regulated by a conditional use permit process. Under such a procedure the <br />question of statute jursidiction would appear to be eliminated and the City <br />given clear power to impose stipulations for the charge. <br />A number of our clients utilize the conditional use permit approach, Oak Park <br />Heights being one example.
