LITTLE CANAD,, <br />nn <br />RE: Lane Auto Body Shop <br />FILE NO: 758.09 - 83.13 <br />BACKGROUND <br />On March 29, 1983, Oscar Lane filed applications for subdivision, variance <br />and home occupation conditional use permit to permit the construction of a <br />32' x 56' garage for use as a body shop at 3069 Arcade Street (see Exhibit A). <br />ISSUES AND ANALYSIS <br />Use. Mr. Lane's property at 3069 Arcade Street is currently zoned "R -1 ", <br />Single Family Residential. The purpose of the "R -1" zoning district is to <br />provide for low density, single family detached residential dwelling units <br />and directly related and complementary uses. Mr. Lane's property and other <br />lots in the immediate vicinity have developed in a manner that is consistent <br />with the purpose of the "R -1" district. <br />Due to the use intensity and the activities associated with an auto body shop, <br />this use is only permitted within the "I -1 ", Light Industrial District as <br />defined in the Little Canada Zoning Ordinance. The applicant is proposing to <br />develop the auto body shop as a home occupation, however, the type of use, <br />the size of the use and the construction of a separate building to house the <br />business, all conflict with the intent of the home occupation provisions of <br />the Little Canada Ordinance. <br />The placement of the body shop in the western lot of Mr. Lane's property would <br />be creating an independent, industrial use within an "R -1" zoning district. <br />The introduction of an auto body shop into a single family neighborhood is <br />incompatible with the existing residential development in this area, violates <br />the intent of the "R -1" zoning district and is in direct conflict with the and <br />use policies established in the Little Canada Comprehensive Plan as follows: <br />General: <br />Page 26 9. Locate related and compatible land uses in compact, functional <br />districts. <br />10.
