I believe the revised plans <br />which showed spacing in compliance with the Ordinance due to the <br />anticipated useage of the excess State right -of -way were viewed positively. <br />If as you suggest that your development can proceed in phases and that <br />the three buildings which would be all or partially located on this parcel <br />could await resolution of the right -of -way question, the Council's position <br />appeared favorable to proceed with the other elements of the project. <br />6. Side Yard Screen and Buffer. I believe the Council fully recognized your <br />positioning the proposed buildings 50 to 60 feet from the west property <br />line. Their suggestion, however, to provide dense, natural screening to <br />protect the adjoining neighbors' view is one which we believe has met <br />and would minimize any issues in this regard. We as a consequence would <br />strongly urge attention to this screening concern and formulating a plan <br />and specifications prior to the next public presentation of the project. <br />7. Private Streets. Your expansion of the paved portion of the private <br />drive from 24 to 30 feet I believe partially addresses the City's concern <br />on this matter. We believe, however, that in the property association <br />articles of incorporation or whatever legal means is utilized to organize <br />control, reference should be made that the private drive is substandard <br />to public street requirements and as a result will not be taken over at <br />a later date by the City for maintenance and repair. The development <br />and /or PUD contract on this project should also make a similar reference. <br />I would hope that these remaining questions of this project could be resolved <br />in the near future and that we could then proceed with a final determination <br />on the matter.
