' I 0 W 3/44 MAP 31 1983 CITY OF LITTLE CANADA March 30, 1983 The Honorable Raymond Hanson Mayor, Little Canada City Hall 515 Little Canada Road Little Canada, Minnesota 55117 RE: Metropolitan Council Appointment for District 3 Dear Mayor Hanson: Thank you for talking to me in regard to my interest in being appointed to the Metropolitan Council. As with other communities in the new district, I have requested to appear before the Council. Mr. Chlebeck has scheduled me to appear at your meeting on April 13th at 8:00 p:m. Enclosed for background information is a copy of my application and a map of the new district. As noted on my application, I have been an elected local governmental offical and community activist for most of my adult life. As a school board member, I have consistently been visible, hard - working, grassroot oriented, well prepared for meetings and honest. T will bring these qualities as a Council member. Generally, I want to pursue several of the recommendations provided in the recently issued report of the Legislative Commission on Metropolitan Governance. Commission recommendations, which were developed from 11 public hearing in the Metro area during the past year, include: 1. External Accountability. The Legislature should strengthen and clarify the accountability of metropolitan agencies in order to improve their responsiveness to the various groups and government agencies interested in metropolitan government. 2. Appointment of Members. The Legislature should improve the procedures for selecting the members of the metropolitan agencies so that the appointment process plays a more important and visible part in educating people about the metropolitan affairs. 6 The Honorable Raymond Hanson March 30, 1983 Page 2 3. Policy and Program Evaluation. The Legislature should strengthen its own oversight of metropolitan agencies and their policies and programs by (1) requiring a more systematic and regular accounting of agency activities to the Legislature, and (2) establishing either a permanent joint commission on metropolitan affairs or permanent subcommittee or divisions of the appropriate House and Senate committees. 4. Metropolitan -Local Disputes. The Legislature should not create elaborate administrative proceedings to deal with disputes between metropolitan and local agencies, nor should the Legislature rely on the courts to settle disputes. For disputes which can't properly be resolved at the metropolitan level, the Legislature should consider creating a process whereby a record of the issues in dispute can be made and brought before a legislative forum. For disputes which do not warrant legislative intervention, the Legislature should establish a procedure for administrative review or reconsideration of agency decisions. 5. Metropolitan Finance. Without increasing the power of the Metropolitan Council or requiring a unified metropolitan budget, the Legislature should create a procedure whereby the separate agency budgets could be assembled and summarized together for the purpose of improving public understanding and discussion. In addition, the Legislature should require long -range budget projections from metropolitan agencies. I also want to vigorously assess the opinions of the people in our district. So far, I have fielded several concerns - ranging from the suburban stormwater overflow to the Blaine airport - and I look forward to hearing your suggestions. Although the project is at this time outside of the legal boundaries of the District, it is located in an area which may potentially be included in the District as the result of the District's Boundary Change Study currently in progress. If this landfill work were to be conducted at a later date after which the District had jurisdiction of the area (depending on the results of the Boundary Change Study), the District would have a number of concerns. As it appears Parcel Ill in combination with Parcel Ik2 would be larger than 1 acre, these parcels would require a District permit. As part of the permit process, a grading plan and erosion control plan would be required for review and approval. All development shall be subject to periodic inspection by the City for the purposes of assuring continued conformity to the provisions of the Conditional Use Permit and this Agreement. 3. All structures and grounds shall be properly maintained at all times in such a manner that the character of the buildings is retained. 4. The Owner shall have his attorney prepare a legal agree- ment specifying terms for joint use of common areas, i.e., parking and'lawn areas, and joint maintenance of the existing structures. This agreement shall be binding on all current and future owners. Upon review and acceptance of the agreement by the City Attorney, a copy shall be incorporated into this Agreement. 5. As used in this Chapter, the terms defined in this Section shall have the following meanings ascribed to them: Massage, Masseur, Masseuse. The word "massage" as used herein is defined as the rubbing, stroking, kneading, tapping, pounding or rolling of any part of a human body with the hands for the purposes of relaxation, physical fitness or beautification. "Masseur" as used herein is defined as a male person who practices massage. The word "masseuse" as used herein is defined as a female person who practices massage. Massage Parlor. The term "massage parlor" is defined as any room or rooms wherein a person may, for a fee, receive a massage. Sauna. A steam bath or heating room used for the purpose of bathing, relaxation or reducing, utilizing steam or hot air as a cleaning, relaxing or reducing agent. 2201.020. LICENSE - REQUIRED. No person, partnership or corporation shall engage in a business, a principal part of which is sauna, without being licensed as provided in this Chapter. 2201.030. LICENSE - APPLICATION. The application shall contain a description and location of the premises to be licensed, the names and addresses of the property owner, business owner, lessee and manager and /or operators; the applictaion shall include whether any of the aforementioned individuals have ever been arrested or convicted of any crime or offense, and if so, should include a description of the offense as to time, place, date and disposition. 2201.040. LICENSE FEE; DISPLAY; TERM. The annual license fee is Ten Thousand Dollars (S10,000.00), which shall not be pro- rated. A separate license shall be obtained for each place of business. The licensee shall display the license in a prominent place on the licensed premises at all times. A license, unless revoked, is for the calendar year, or a part thereof, for which it has been issued. 2201.050. LICENSE - GRANTING; DENIAL; RESCISSION. (A) All applications for a License shall be referred to the Chief of Police, and to such other City Departments as the City Clerk shall deem necessary, for 154 20 verification and investigation of the facts set forth in the application. The Chief of Police shall cause to be made such investigation of the information requested in Section 2201.030 as shall be necessary and shall make a written recommendation and report to the City Council. The City Council may order and conduct such additional investigation as it shall deem necessary. Opportunity shall be given to any person to be heard for or against the granting of such license. (B) The following shall be the grounds for denial of license applications: 1. The premises to be licensed is not located in the appropriate zone as determined by the City Council and the laws and ordinances of the City. 2. The premises to be licensed do not meet the safety and sanitary requirements of the City Council and of the Building Code regulation of the City. 3. If there is any fraud or deception involved in the license application. 4. If the applicant or persons in his employ are not complying with or have a history of violation of the laws and ordinances applicable to health, safety or moral turpitude. 5. If the applicant is a person of bad repute, or has in his employ, or is owned by any persons of bad repute. (C) The following shall be grounds for rescinding a license granted to any person, partnership or corporation: 1. Failure to comply with any of the ordinances of the City or statutes of the State. 2. If the owner, manager, Lessee or any of the employees are found to be in control or possession of any alcoholic beverages or narcotic drugs and controlled substances on the premises, possession of which is illegal. 3. If the owner, manager, lessee or any of the employees are convicted of any ordinances or statute violation arising within the business establishment to which the license was granted. 4. If the premises do not comply with the health, safety and building regulations of the City. 2201.060. CONSTRUCTION AND MAINTENANCE REQUIREMENTS. (A) All sauna rooms and restrooms and bathrooms used in connection therewith shall be 2 • ) constructed of materials which are impervious to moisture, bacteria, mold, and fungus growth. The floor -to -wall and wall -to -wall joints shall be constructed to provide a sanitary cove with a minimum radius of one (1 ") inch. (3) All restrooms used in connection with saunas shall be provided with mechanical ventilation with twenty (20) cfm per square foot of floor area, a minimum of thirty (30) foot candles of illumination, hand wash sink equipped with hot and cold running water under pressure, sanitary towels and a soap dispenser. (C) Each sauna shall have a janitor's closet which shall be provided for the storage of cleaning supplies. Such closet shall have mechanical ventilation with two (2) cfm square foot of floor area and a minimum of thirty (30) foot candles of illumination. Such closet shall include a mop sink. (D) Floors, walls and equipment in sauna rooms, in restrooms, and in bathrooms used in connection therewith must be kept in a state of good repair and clean at all times. Linens and other materials shall be stored at least twelve (12 ") inches off the floor. Clean towels and wash cloths must be made available to each customer. (E) Individual lockers shall be made available for use by patrons. Such lockers shall have separate keys for locking, and there shall not be any locks on any doors to rooms that are used for the purpose of giving massages. 2201.070. EMPLOYMENT OF AND REGULATIONS FOR MASSEURES AND MASSEUSES. (A) Any person acting as a masseur or a masseuse in any such business shall have his registration certificate or a true copy thereof displayed in a prominent place on the licensed premises. (3) All saunsas will be open to the general public, but only a registered masseur will be allowed to massage male customers, and only a registered female masseuse will be a11owr4 co massagii: female customers,. (C) Whenever a massage is given, it shall be required by the masseur or masseuse that the person who is receiving the massage shall have the lower abdomen covered with an appropriate non — transparent covering. (0) Any masseur performing any massages shall at all times have the lower part of the body covered with a non — transparent material. (E) Any masseuses performing massages shall at all times have the upper and lower part of the body covered with a non — transparent material. 220L.080. MINORS RESTRICTED. No person under the age of eighteen (18) years of age shall be permitted at any time on the licensed premises as a •• customer, guest or employee unless accompanied by his or her parent or guardian in any premises when massages are being given. 9') 2201.090. RIGHT OF ENTRY FOR INSPECTION. Any duly authorized law enforcement officer, health officer or building inspector shall be allowed to inspect the licensed premises at reasonable times and hours to insure compliance with all provisions of this Chapter. 2201.100. IDENTIFICATION OF EMPLOYEES. Upon demand by any police officer, any person engaged in providing services in any licensed premises shall identify himself giving his true legal name and his correct address. 2201.110. REGISTRATION OF MASSEURS AND MASSEUSES. (A) Before any person engages in providing services as a masseur or a masseuse in any licensed establishment, he shall register with the police department of the City. Such registration shall include a photocopy of the person's state registration certificate and photographs of the registrant, taken by the police department, showing both the front and the side view. When any such person ceases to be employed by the licensee, the police department shall be notified so that the department has on file at all times a current list of the persons operating as masseurs or masseuses on the licensed premises. It shall be required that any person who engages in the occupation as a masseur or masseuse shall annually be photographed and fingerprinted by the police department of the City. (B) No sauna for which a license has been granted by the City shall be open for business unless and until any masseurs or masseuses employed in the business have first complied with the registration requirement of this Chapter. 2201.120. INTOXICATING OR NON- INTOXICATING LIQUOR. Intoxicating or non - intoxicating liquors shall not be allowed on any premises licensed as a sauna at any time. A violation of this Section shall be grounds for immediate revocation of the license. 2201.130. HOURS. Every sauna shall close for business between the hours of 12:01 o'clock a.m. and 8:00 o'clock a.m. daily. 2201.140. VIOLATIONS. Every person who commits or attempts to commit, conspires to commit, or aids or abets in the commission of any act constituting a violation of this Chapter, whether individually or in connection with one or more other persons or as a principal, agent or accessory, shall be guilty of such act, and every person who falsely, fraudulently, forcibly or willfully induces, causes, coerces, requires, permits or directs another to violate any of the provisions of this Chapter is likewise guilty of such offense. Because our rates are based on cost of service, it is to both' your city and NSP's advantage to convert these units to energy efficient high pressure sodium instead of replacing the old mercury ballasts. This would also be in line with the national and NSP's commitment to energy conservation. In response to these objectives, NSP has developed a new program to reduce the number of energy inefficient street lights on its system. The options under this program are as follows: 1. At your request, NSP will convert any NSP owned overhead incandescent or fluorescent street light to new energy efficient high pressure sodium at no charge for the conversion. The monthly billing for energy and maintenance will be changed to the high pressure sodium rate which will usually result in lower cost to your city if present light levels are maintained. 2. At your request, NSP will convert any NSP owned overhead mercury street light to a new energy efficient high pressure sodium unit. The one time conversion charge to convert a mercury unit to high pressure sodium is $5.00 per unit. The monthly billing for energy and maintenance will be changed to the high pressure sodium rate which will result in a slightly higher cost tooytpur city but will also slightly raise the light lev&1 in your city. 27 Page Two March 9, 1983 2. (cont) The one time conversion charge will remain at $5.00 for all requests received by NSP during the calendar years 1983 and 1984. After this time, NSP costs will be re- evaluated and the one time conversion charge will most likely be higher. Enclosed is a sample agreement that would be executed under this option. 3. An option to the above program would be for your city to authorize NSP, in writing, to convert all mercury street lights to high pressure sodium as the mercury ballasts fail. There would be no one time charge for the conversion. The monthly bill- ing for energy and maintenance would be changed to the high pressure sodium rate. With this option, however, your city would have a mixture of lights for many years. A sample letter is enclosed should you chose this option. Because of the necessity of scheduling this conversion work as to available crew time, NSP may not be able to make the conversions when you request it, and may also have to schedule the work over a period of time. The four ball fields located on the south side of Little Canada School is one area of concern, and the proper- ty west of Little Canada School, known as Spooner Park is the other. Both of these facilities are at the present time being maintained by the City of Little Canada, and Spooner Park was constructed in its entirety in 1975 by the City of Little Canada. It is our primary concern that our Community does not own a major area of land for either ball Fields or a park that we can be assured of in the years to come. We have enjoyed a very good relationship with the School District concerning the use of these facilities for the residents of our Community in the past. However, we feel that our people would like to have the assurance of knowing that these facilities will also be here for the enjoyment of their children and grandchildren as well. In these times of declining enrollment in our School District, and the uncertainty of not knowing the School Board's thoughts c., open Land and school closings, we would like the School Board to consider our suggestions of land purchase.
