GENERAL REQUIREMENTS. <br />1. All uses and construction shall be in compliance with <br />all applicable codes and ordinances of the City, except as modified <br />herein. <br />2. Concept approval and Development Stage Plan approval <br />have been granted . by the City. The proposed second story addition <br />will require subsequent City approval. <br />3. In the event any of the real property described above <br />is conveyed in total or in part, the buyer shall be bound by the <br />provisions of the Conditional Use Permit and the plans which are <br />a part of this Agreement. <br />4. More detailed and complete site and building plans may <br />be required from time -to -time as development proceeds within the <br />above described property. <br />5. Any requests for major deviation from the approved plans <br />may require a public hearing and subsequent approval by the City. <br />6. Where there are particular difficulties or unnecessary <br />hardships resulting from the application of the strict letter of <br />the 'provisions of this Conditional Use Permit, an appeal may be <br />made and a variance may be granted as provided for in the Zoning <br />Code of the City. <br />7. The conditions of this Agreement are applied to the land <br />and shall not be affected or altered by any subsequent sales, <br />lease, rental, or any other change in ownership or tenant status, <br />except as may be modified herein. <br />SUBDIVISION REQUIREMENTS. <br />1. The concept of the proposed lot split was approved by the <br />City by Resolution No. 82 -290 on May 26, 1982. No part of the <br />above described property shall be sold or otherwise transferred <br />from the present ownership except under the terms of a City Council <br />approved subdivision, in accordance with the Little Canada Sub- <br />division Ordinance. <br />2. Any and all subsequent development shall be subject to <br />the provisions of the Conditional Use Permit and all provisions <br />of this Agreement and said provisions shall apply following said <br />subdivision and sale of individual lots. The City shall require <br />proof that all subsequent owners are aware of said conditions <br />and provisions. <br />LANDSCAPING. <br />1. Landscaping shall be provided as indicated on the approved <br />Site Plan and an approved detailed Landscaping Plan. The Landscaping <br />15 <br />-2- <br />
