Plan shall be reviewed by the City Planner and approved by the City <br />and shall be incorporated into this Agreement as an exhibit. <br />2. Should any activities of the owner in connection with the <br />overall development adversely effect the approved landscaping, the <br />Owner shall do appropriate restoration within a reasonable time. <br />ADDITIONAL PROVISIONS. <br />1. The City has approved two freestanding signs plus the <br />wall signs which currently exist. A signage plan showing the <br />extent of all signage shall be incorporated in this Agreement. <br />2. All development shall be subject to periodic inspection <br />by the City for the purposes of assuring continued conformity <br />to the provisions of the Conditional Use Permit and this Agreement. <br />3. All structures and grounds shall be properly maintained <br />at all times in such a manner that the character of the buildings <br />is retained. <br />4. The Owner shall have his attorney prepare a legal agree- <br />ment specifying terms for joint use of common areas, i.e., parking <br />and'lawn areas, and joint maintenance of the existing structures. <br />This agreement shall be binding on all current and future owners. <br />Upon review and acceptance of the agreement by the City Attorney, <br />a copy shall be incorporated into this Agreement. <br />5. All maps, reports, exhibits, and other documents attached <br />to this Agreement which are properly approved and filed shall be <br />considered as a part of this Conditional Use Permit and shall have <br />the same force and effect as if fully set forth herein and are <br />hereby made a part of this Agreement. <br />6. Owner agrees to continue to lease the tennis court to the <br />City, and, in consideration for the use of the tennis court, the <br />City agrees to continue to maintain the lawn at the office building. <br />This lease shall be by separate agreement with annual lease periods. <br />7. Owner agrees to donate to the City Park Fund at the time <br />of the City's approval of the lot split an amount equal to five <br />(5 %) percent of the appraised value of the above described property, <br />without structures. The appraised value shall be determined as of <br />the time of the approval of the lot split. <br />8. This Agreement shall be recorded in the office of the <br />County Recorder of Ramsey County. <br />9. The Owner agrees that this Agreement shall be binding <br />upon their successors and assigns. <br />l 6 <br />-3- <br />
