The proposed interior circulation consists of a private <br />street, which is a 30 foot wide road surface only with no public right -of -way <br />that will be owned and maintained by the homeowners themselves. A private <br />street is typically requested when the required street right -of -way width <br />cannot be met. All homeowners are to understand via the Property Owners <br />Association Agreement that the maintenance (repairs, sweeping, snowplowing, <br />etc.) is their functional and financial responsibility. It should be clearly <br />spelled out in the Development Agreement that at no time in the future will the <br />City take any responsibility for the street. The acceptance of a private street <br />would be a major policy decision bythe City and should probably precede dis- <br />cussion of any other aspect of the project. <br />The site has been graded very tightly behind each row of structures to a 30% <br />slope which is the maximum slope that will support vegetation. Retaining <br />walls have also been utilized. The proposed drainage pattern directs most <br />runoff appropriately to the wetland north and will not increase amounts of <br />runoff to the west and south. The City Engineer should also comment on the <br />grading and drainage. <br />Each unit will have a two car garage which meets the parking requirements for <br />the site. <br />The 40 foot width of the driveways exceeds the maximum 24 foot width allowed <br />on a public street, which is of particular concern on Viking Drive. This <br />can be an Ordinance modification allowed under the P.U.D. However, it is <br />recommended that the Homeowners Association spell out how snow removal and <br />deposition will be handled. <br />The City Engineer should review the proposed utility plans and make recom- <br />mendations on whether they should be public or private. We hope to have <br />comments on this at your meeting on 3 March. <br />The structures in a planned unit development need only meet respective district <br />setback requirements at the front (30 feet) and side:. (15 feet) of the project <br />site. The structures along Viking Drive right -of -way, the front of the property, <br />do not meet this requirement (specifically, structures 0, L, J, A, B, C and D). <br />However, this design may be alleviated due to the possibility that state -owned <br />Viking Drive may be transferred to the City of Little Canada. The mechanics <br />of this transfer will be discussed in a separate report. If this occurs, the <br />right -of -way width could be reduced to a more typical 50 or 60 feet, in which <br />case all structures would meet the setback requirement. If the Department <br />of Transportation cannot make this transfer within a reasonable time period <br />as judged by the applicant, or decides not to transfer the road, a variance <br />will be needed from the requirement. Due to the excess of right -of -way in <br />front of structures 0, L, and J, a variance appears justified since the <br />land is basically otherwise unuseable. <br />42 <br />
