ISSUES AND ANALYSIS <br />Rezoning: <br />Prior to City approval of the rezonings in the South Owasso <br />Boulevard area, several property owners in this area including <br />Mr. Frattalone, expressed concern regarding the ramifications of <br />the proposed rezonings. A Planning Report prepared by this <br />office re- evaluated the recommended rezonings. NAC's 7 October <br />1988 report determined that the Ordinance allows non - conforming <br />uses and structures to continue operations indefinitely, provided <br />the non - conforming situations are not increased or destroyed by <br />more than fifty (50) percent. Also, some expansion may be <br />allowed provided all building and site zoning regulations can be <br />met. The report also notes that the Ordinance provides this <br />flexibility to avoid penalizing existing businesses. <br />Mr. Frattalone has expressed an interest in submitting a request <br />for several text amendments to the I -1 District whereby <br />landscaping and screening provisions would be more stringent than <br />current district requirements. <br />Our office has not received any such documentation from the <br />applicant at this point, so it is not possible to address or <br />comment on such a proposal. <br />SUMMARY <br />As stated in NAC's 7 October 1988 Planning Report, the recently <br />approved rezonings appear necessary due to the amount of vacant <br />land involved, the high visibility of the area, and the existing <br />development in the area that has provided high quality buildings <br />and well landscaped sites by choice, not by regulation, as well <br />as lower investment properties in the same area. <br />However, should the City wish to review the applicant's proposed <br />I -1 District amendment request, we suggest tabling this rezoning <br />request until City staff can review and comment on any changes to <br />the I -1 provision. <br />cc: Joe Chlebeck <br />John Palacio <br />Tom Sweeney <br />Don Carley <br />Frank Frattalone <br />Page 51 <br />
