Fay <br />State Aid Engineer <br />SUBJECT: Revised Agency Agreement <br />Utility Accommodation Policy <br />Enclosed are two copies of a revised agency agreement which cover <br />Federal aid highway funded projects. <br />This agreement has been revised to incorporate by reference <br />A Policy for the Accommodation of Utilities on Highway Rights <br />of Way. (See page 13) This is necessary in order to comply with <br />Federal Highway Program Manual Volume 6, Chapter 6, Section 3, <br />Subsection 2, (FHPM 6- 6 -3 -2) Accommodation of Utilities. <br />Copies of both A Policy for the Accommodation of Utilities on High- <br />way Rights of Way and FHPM 6 -6 -3 -2are enclosed for your reference. <br />The requirements of the accommodation policy apply to active <br />projects under development or construction when Federal -aid funds <br />are being or have been used on the involved highway facility. <br />We anticipate that application of the utility accommodation policy <br />will involve a permitting process which reflects consideration and <br />application of design and location parameters as outlined in the <br />policy. No doubt many cities and counties already have a formal <br />utility permitting process established. <br />It is requested that both copies of the agency agreement be executed <br />by the appropriate City or County officials and returned to this <br />office with certified resolutions.
