at its expense pursuant to Minn. Stat. Chapter 429 and will <br />assess the cost of construction of said public improvements <br />against the real property described herein owned by the <br />District. The District agrees to execute the necessary <br />documents to stipulate as to the amount of the benefit to its <br />property and to waive any right to appeal from the special <br />assessment of the costs of the construction of said public <br />improvements. The District agrees to pay said special <br />assessments as levied over a year period. <br />Section 6. Operation of Facilities. The expansion of the <br />facilities at the Little Canada Elementary School and the public <br />improvements described above shall be operated and maintained on <br />behalf of the City and the District by the District. The <br />District agrees to pay all costs of operation and maintenance <br />and to provide all personnel necessary for this purpose. Any <br />person employed by the District for the operation and <br />maintenance of the facilities and public improvements shall not <br />be an employee of the City for any purpose, including the <br />purposes of compensation, pensions, worker's compensation, <br />taxation or labor negotiations. The District shall prepare and <br />adopt rules and regulations governing the use of the addition to <br />Little Canada Elementary School by its students and others under <br />its jurisdiction, and by others, but such rules and regulations <br />shall be subject to prior approval by the City Council or its <br />designated representatives as they relate to the use of the <br />addition to the Little Canada Elementary School and public <br />Page 64 <br />
