with an 80 foot lot width. The lot in question, is a total of <br />18,380 square feet, with a lot width of 91.9 feet. The moved <br />garage will add a total of 96 square feet to the building <br />coverage of the lot, which currently has 1,837 square feet of <br />structure coverage. There must be at least 500 square feet of <br />usable open space on the lot, there is 16,543 square feet, much <br />more than is required. <br />Setbacks: <br />Little Canada City Ordinance requires a minimum "five (5) foot <br />side yard setback for the principal building and for any future <br />attached additions to such buildings...the five (5) foot side <br />yard requirement shall apply only to the principal building..." <br />(Ord. 905.050) The moved garage is a detached structure which <br />is a permitted accessory use. The ordinance cited above states <br />that, "accessory buildings in all cases shall maintain a minimum <br />side yard setback of ten (10) feet." <br />The existing garage, which is presently pushed back off the <br />existing concrete slab, was constructed two and one -half (2 1/2) <br />feet into the required side yard. Side yard setbacks, as well as <br />rear and front yard setbacks, are required not only to create <br />more uniform development which avoids irregular yard depths and <br />attempts to provide pleasing aesthetic views for all residents, <br />but are designed to create buffer zones between properties and <br />structures. The property to the south of the applicant's <br />property is entitled to the buffer zone created by the required <br />setbacks for both parcels. Setback requirements should be <br />uniformly enforced and brought into conformance whenever <br />possible. <br />Non - Conforming Structures: <br />Three portions of the Little Canada Ordinance General Provisions <br />Section, apply to this situation. Ordinance Section 903.010 D., <br />states that "no non - conforming building structure or use shall <br />be moved to another lot or to any other part of the parcel of <br />land upon which the same was constructed or was conducted at the <br />time of this Ordinance adoption unless such movement shall bring <br />the non - conformance into compliance with the requirements of this <br />Ordinance." <br />To move the replacement garage onto the lot in question, and <br />place it on a concrete slab that does not provide for the <br />required side yard setback, would be in violation of the <br />Ordinance Section cited above (903.010 D.). <br />Page 41 <br />
