MINUTES <br />Planning Commission <br />September 8, 1988 <br />FinaServe <br />Sign <br />Taco John's <br />The City Planner reported that he received calls from Levitz, Art <br />Flieshhacker and Ramsey County inquiring about the effect of the <br />rezonings on his property. <br />The City Planner reported that the public hearing at Council level <br />will be held on September 28th, however, the Council will table action <br />pending a recommendation from the Planning Commission. <br />Davison informed the public that the matter will be on the agenda of <br />the next Planning Commission meeting. <br />DeLonais pointed out action on the Mid -West Spring variance which allows <br />Mid -West Spring to maintain existing setbacks and not increase a non- <br />conformity on their site. <br />DeLonais felt the same situation was evident in the FinaServe sign <br />variance request. FinaServe is improving their property and should be <br />allowed to replace their existing sign at the same height and not increase <br />the non - conformity. <br />DeLonais felt the Sign Ordinance should be amended to allow this. <br />The City Planner suggested that the Commission act on the rezoning of <br />the Taco John's site, however, recommended that action on the Conditional <br />Use Permit be tabled since the site plan was just received and there are <br />some problems with it. <br />The Planner pointed out that Taco John's is requesting B -3 zoning, which <br />is what is proposed for the property in the City's Comprehensive Plan. <br />Mr. Davison recommended approval of the rezoning of the Taco John's <br />property to B -3 based on the recommendation of the City Planner and <br />the City's Comprehensive Plan. <br />Motion seconded by Costa. <br />Motion carried 4 - 0. <br />Mr. Davison recommended that the Taco John's Conditional Use Permit <br />request be tabled based on the recommendation of the City Planner. <br />Motion seconded by Costa. <br />Motion carried 4 - 0. <br />Page 10 <br />
