MINUTES <br />Planning Commission <br />September 8, 1988 <br />he will not be able to expand his existing building. <br />DeLonais asked DeBace what the soil conditions were for the area, <br />including the trailer park. <br />DeBace replied that the soil conditions improve towards the west. <br />The City Planner reported that the Ordinance provides that a non- conforming <br />use can be expanded up to 25% of the existing floor area, as long as <br />setbacks and other Code requirements are met. <br />DeBace reported that if that provision is true, he was not informed of it <br />in a past development proposal he had before the City and as a result it <br />cost him a lot of money. <br />George Doherty, Vincent Metals, voiced reservations about the rezoning <br />proposal and reported that he has not had an opportunity to fully <br />investigate the ramifications of the proposal. Doherty requested an <br />opportunity to investigate the rezoning and its effects on his property <br />and requested that the matter be tabled to give him an opportunity to <br />do so. <br />DeLonais pointed out that the Planning Commission just received the <br />information last week, and he, too, felt the proposal should be tabled <br />for further study. <br />Doherty felt that the 35% land coverage provision of the IP District <br />would place severe limitations on the Vincent Metals property. <br />Harry Kath, Kath Bros. questioned why his property was being proposed as <br />B -2, pointing out that the auto parts sales is only a small percentage of <br />his business. The majority of his business is petroleum sales. Kath <br />pointed out that the surrounding property is all being proposed as B -3. <br />The City Planner reported that his reasoning for proposing B -2 for the <br />Kath Bros. property is that B -2 zoning fits the existing use of the site. <br />Kath stated that he is not in favor of the rezoning of his property to <br />B -2. <br />Davison agreed that the matter should be tabled at this time, pointing <br />out the considerable input received from the businesses effected. <br />Davison felt that the matter needed more study and a determination <br />should be made as to the effect of the rezonings on property values. <br />DeLonais recommended that the multiple rezonings recommended by the <br />City Planner be tabled for one month pending further study. <br />Motion seconded by Davison. <br />Motion carried 5 - 0. <br />Page 9 <br />
