Recommendation <br />All privileges gained by the applicant with the PUD designation, <br />as discussed earlier in this report, allow for flexibility in <br />developing this area. By allowing this flexibility, the City in, <br />turn can require higher development standards. The situation <br />with R & S and other uses in this area stems from land uses that <br />were developed prior to existing development standards. The <br />nonconformities existing are legal but the intent of the <br />Ordinance is to eventually phase them out. The site <br />improvements to take place at the R & S site will benefit the <br />City in it's attempt to clean up this portion of the Woodlyn <br />Avenue area. The right -of -way dedication at this site will <br />provide an improved access to the rear properties that will <br />benefit the City and the property owners as well. Although no <br />time limit has been effectively set on the phasing out of the <br />nonconforming salvage , this operation will be <br />discontinued when R & develops the rear of this property. <br />Based on this report, provided the revised R & S plan illustrates <br />all requirements, we recommend Development Stage approval subject <br />to the following being met: <br />1. Auto salvage operation is phased out within three years. <br />2. The east end of Woodlyn Avenue is improved to include <br />paving, curbing and installation of a cul -de -sac subject to <br />City Engineer review. <br />3. City parking, landscaping, paving and curbing, and screening <br />performance standards are met. <br />4. A 50 foot wide street access from Woodlyn Avenue to the <br />proposed southern lot shall be gained via a shared road <br />easement along the west property line (30 feet) of R & S and <br />along the east property line (20 feet) of Empire Rebar. <br />5. Applicant's property must be cleaned up; all debris shall be <br />removed. <br />6. Municipal services shall serve all existing and new <br />buildings on site when available. <br />7. A detailed grading and drainage plan shall be submitted. <br />Plan shall illustrate grading and drainage for the entire <br />area. <br />8. Landscape Plan. <br />9. Resolve issue of acquisition of Empire Rebar's portion of <br />R.O.W. <br />10. Applicant shall enter into a development agreement with the <br />City to ensure all improvements will occur. <br />Page 93 <br />
