Non - Conforming Buildings - The Meyer Enterprises building is non- <br />conforming because it does not meet "I -1" district front or side <br />yard setback requirements. <br />Access: <br />Per NAC's 8 August 1988 Planning Report, the City Council has <br />directed the applicant to dedicate an additional 10 feet of road <br />right -of -way on the west portion of the R & S property for a <br />total of 30 feet of right -of -way from R & S. This dedication, <br />combined with 20 feet proposed to be dedicated by Empire Rebar, <br />will create a 50 foot wide access to the rear properties. <br />Dedication of an easement for a cul -de -sac will not occur until <br />the exact location is determined, at which time R & S will <br />convey, at no cost to the City, the additional easement. <br />Language depicting this agreement shall appear in the Development <br />Contract to be entered into by R & S and the City. <br />The applicant has indicated that Empire Rebar has verbally agreed <br />to dedicate 20 feet along it's east property line for the street. <br />The details of this dedication must be finalized legally before <br />the proposed subdivision can take place. The dedication of 20 <br />feet from Empire Rebar plus R & S Auto's dedication of 30 feet <br />must occur to ensure access to the proposed southern lot. <br />Parking: <br />The revised site plan to be submitted by the applicant shall <br />delineate parking spaces that conform to Ordinance standards in <br />regard to amount, surfacing, curbing and striping. <br />Landscaping: <br />A landscape plan including a detailed planting list with sizes <br />and species shall be submitted as part of the Final Plan. <br />Drainage: <br />A drainage plan shall be submitted for City review prior to any <br />final City action. Said plan shall depict existing and proposal <br />drainage patterns for the entire site. <br />Development Agreement: <br />The City and the applicant shall enter into a development <br />contract at the time the Final Plan is being considered. This <br />agreement shall be for the purpose of ensuring that all easements <br />and improvements will be provided in a timely manner by the <br />applicant. <br />Page 92 <br />
