C. Total Compensation <br />The City shall compensate the Consultant for those services <br />outlined in Paragraph III, in an amount not to exceed $4,400, <br />including items A and B above, unless amended by both parties in <br />writing. <br />D. Duration of Contract <br />The Consultant shall begin evaluation of the development potential <br />of the site immediately upon authorization. It is expected that <br />the analysis can be completed within a 30 day period. <br />V. Schedule of Payments: <br />The Consultant may bill the City monthly for the amounts due as per the <br />hourly rates, outside services and reimbursable expenses as provided for <br />herein. <br />VI. Extra Services: <br />Any additional service required by the project or requested by the City <br />to be performed by the Consultant shall be paid as agreed between the <br />parties and added through an approved Contract Execution Order. <br />VII. Past -Due Accounts Interest: <br />The City shall pay at the Consultant's office the amounts due on <br />statements rendered within 30 days from receipt thereof, or they will be <br />considered past due. Past due bills shall bear interest at the maximum <br />rate allowed by law. <br />VIII. Cooperation Between City and Consultant: <br />It is the intent of this Agreement that a close cooperative working <br />relationship be attained between the City and the Consultant at all <br />levels of management and staff. <br />Among the City's specific responsibilities under this Agreement are: <br />A. To make available, at no cost, in a timely manner, to the <br />Consultant any available data, studies, reports, maps and plats in <br />its possession or available to it pertinent to the services to be <br />performed. <br />B. To assist the Consultant in arranging and scheduling meetings and <br />contacts with local public officials and private agencies and <br />individuals. <br />C. To provide any legal information, guidance, advice and opinion <br />necessary hereunder. <br />PAGE =14 <br />
