C. Total Compensation The City shall compensate the Consultant for those services outlined in Paragraph III, in an amount not to exceed $4,400, including items A and B above, unless amended by both parties in writing. D. Duration of Contract The Consultant shall begin evaluation of the development potential of the site immediately upon authorization. It is expected that the analysis can be completed within a 30 day period. V. Schedule of Payments: The Consultant may bill the City monthly for the amounts due as per the hourly rates, outside services and reimbursable expenses as provided for herein. VI. Extra Services: Any additional service required by the project or requested by the City to be performed by the Consultant shall be paid as agreed between the parties and added through an approved Contract Execution Order. VII. Past -Due Accounts Interest: The City shall pay at the Consultant's office the amounts due on statements rendered within 30 days from receipt thereof, or they will be considered past due. Past due bills shall bear interest at the maximum rate allowed by law. VIII. Cooperation Between City and Consultant: It is the intent of this Agreement that a close cooperative working relationship be attained between the City and the Consultant at all levels of management and staff. Among the City's specific responsibilities under this Agreement are: A. To make available, at no cost, in a timely manner, to the Consultant any available data, studies, reports, maps and plats in its possession or available to it pertinent to the services to be performed. B. To assist the Consultant in arranging and scheduling meetings and contacts with local public officials and private agencies and individuals. C. To provide any legal information, guidance, advice and opinion necessary hereunder. PAGE =14
