MINUTES <br />City Council <br />Jan. 27, 1988 <br />Gardner <br />Bros. <br />Fahey reported that the matters of the Gardner Bros. sign variance <br />and lot split have been cancelled. <br />Agenda <br />Items No. 6 & 8 <br />Flashing Mr. Dennis Nelson, representing Family Video on Little Canada Road, <br />Lights appeared before the Council. Nelson reported that the City has <br />Family received a complaint about the flashing lights at Family Video and <br />Video the Building Inspector has informed him to discontinue flashing these <br />lights. Nelson reported that there are residential homes closer than <br />Agenda the one whose owner is complaining, and these residents have not voiced <br />Item No. 9 any complaints about the flashing lights. Nelson felt that the complaint <br />was not a legitimate one and that he was being harassed. <br />The City Planner reported that he discussed this situation with the <br />Building Inspector, and City ordinance prohibits the intermittent <br />flashing of lights except in the case of holiday signs. The Planner <br />reviewed the ordinance and it was noted that the ordinance provides <br />that holiday signs can be displayed for a period of 45 days, but not <br />longer than two days following the holiday. <br />Council discussed the matter and felt that the ordinance roust be <br />enforced. It was suggested that Nelson obtain a copy of the ordinance, <br />and that he follow the provisions of the ordinance with regard to <br />holiday signs. <br />Council agreed that the Building Inspector should continue to enforce <br />the ordinance as it pertains to flashing lights and holiday signs. <br />Bank Shot Fahey reported that at the second Council meeting in December, the <br />Billiards City Council approved a conditional use permit for Bank Shot Billiards <br />for a billiard center and established a closing time of 4 A.M. and <br />Agenda a maximum of 8 amusement devices on the premises. <br />Item No. 10 <br />At the January Planning Commission meeting the Commission discussed <br />this matter at length and due to concerns expressed by the public to <br />various Commission members, recommended that the Council reconsider <br />the terms of the conditional use permit. The Planning Commission felt <br />a 1 A.M. closing time should be set and that the business be limited <br />to 4 amusement devices. <br />The Planning Commission also asked if the City had a curfew law and, <br />if not, suggested that a curfew law similar to the City of Roseville's <br />be adopted and enforced. <br />Fahey pointed out that the City does have a curfew law which is more <br />stringent than Roseville's establishing a 10 P.M. curfew for children <br />under the age of 18. Roseville's curfew is 10 P.M. for children under <br />16 and Midnight for children under 18. <br />Page 17 <br />
