MINUTES <br />City Council <br />Jan. 27, 1988 <br />Bank Shot <br />Billiards <br />(Cont.) <br />Fahey reported that the Planning Commission also asked if the City <br />had a loitering ordinance, which it does. However, the loitering <br />ordinance applies to children under the age of 18 and not to adults. <br />Blesener pointed out that adults are covered under the disorderly <br />conduct ordinance. <br />Fahey reported that he contacted Mr. Schifsky of Bank Shot Billiards, <br />who indicated that in the interest of being good neighbors, they would <br />agree to a 2 A.M. closing time and a limit of 4 amusement devices for <br />a period of 120 days, after which time the Council would review with <br />thoughts of extending the closing time to 4 A.M. and increasing the <br />amusement devices to 8 if there have been no problems at the center. <br />Fahey reported that he personally has received no complaints about the <br />Council's action in approving the CUP for Bank Shot Billiards. However, <br />since concerns may exist over the billiard center and the billiard <br />center has expressed a willingness to accept the 2 A.M. closing and <br />limit on amusement devices on a voluntary basis with a 120 day review, <br />he would support the amendment to the CUP. <br />Blesener noted that the Planner had recommended a limit of 5 amusement <br />devices at the billiard center originally, and it was the Planning <br />Commission who increased that number to eight. <br />Fahey pointed out that the Planning Commission is requesting a 1 A.M. <br />closing time, but originally approved a 2 A.M. closing time. Fahey <br />felt that the 2 A.M. closing time should be set for the 120 day period. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 88 -1 -26 - RECONSIDERING RECENT <br />CITY COUNCIL ACTION APPROVING A CONDITIONAL <br />USE PERMIT FOR BANK SHOT BILLIARDS AND BRINGING <br />THE MATTER BACK TO TABLE IN LIGHT OF RECENT <br />RECOMMENDATIONS FROM THE PLANNING COMMISSION <br />REGARDING CLOSING TIME AND NUMBER OF AMUSEMENT <br />DEVICES <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Blesener, Collova, LaValle, Fahey, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 19, Page 27. <br />Blesener reported that he has received no complaints about the Council's <br />recent actions approving a CUP for Bank Shot Billiards. Fahey replied <br />that he has received no complaints as well <br />Scalze reported that concerns have been expressed to her about this <br />approval. <br />Page 18 <br />
