DeBace pointed out that both buildings would be sprinkled <br />which is a big expense. <br />The Planner stated that the three -year period was a starting point. <br />The Planner pointed out that the Council indicated that since junk <br />yards are a non - conforming use, no improvements could be made to <br />non - conforming uses without bringing the situation into conformance. <br />DeBace also pointed out that one of the additions will enfringe into <br />the 40 foot setback by 2 feet. <br />The Planner stated that the setback variance was a reasonable one, <br />pointing out that the sight lines on the street are at about 19 feet. <br />DeBace again objected to the 30 foot right -of -way from R & S. <br />The Planner pointed out that R & S would have 25 to 26 feet in front <br />of their garage doors and this should leave them adequate room. <br />DeBace disagreed, pointing out that if anyone parked in front of the <br />garage doors the rest of the site would be blocked off. <br />Costa asked if additional land could be taken from the Zilge property. <br />The Planner pointed out that the right -of -way is already within 7 or <br />8 feet from the Zilge building. <br />Costa asked if there is a lot of traffic using this road. <br />Louie Rustad replied that there was limited traffic and pointed out <br />that the 40 foot road has been no problem for the past 15 years. <br />Davison asked if a 45 foot right -of -way would be a compromise that <br />R & S could live with. <br />DeBace again objected to taking more right -of -way from the R & S property <br />than from the Zilge property. <br />DeLonais asked if there were any other streets in the City with 40 -foot <br />right -of -ways. <br />The Planner replied that there is a residential street off of LaBore <br />that has a 40 foot right -of -way with a 10 foot easement for a short <br />section. <br />DeBace felt there was more traffic on that street than there is on the <br />street adjacent to R & S. DeBace felt that the snow storage concern <br />was not legitimate pointing out that R & S would remove the snow from <br />their property, if necessary. <br />Costa pointed out that if the road right -of -way remains at 40 feet, anyone <br />buying property in the area will be aware of the situation and developments <br />can be planned accordingly. If the street is a problem, developers will <br />find other property. <br />Page 3 <br />
