Development Agreement: <br />The Applicant shall enter into a development contract with the <br />City. Said agreement shall contain all required improvements the <br />applicant agrees to provide the City. A time table for <br />improvements shall be included in the contract and monies to <br />cover all improvements shall be put in escrow to ensure <br />completion. <br />RECOMMENDATION <br />This report clearly illustrates that this proposed subdivision <br />will create some non - conformities at the site in question. <br />However, these allowances by the City will, we believe, be offset <br />by allowances from the applicant to the City. The improvements <br />in the area to be supplied by the applicant will not only clean <br />up existing negative situations in this area but improvements to <br />the area and the eventual phasing out of the auto salvage <br />operation appear to be trade -offs that will substantially benefit <br />the City as a whole. Therefore we recommend approval of the PUD <br />Concept Plan corresponding subdivision of the site in question; <br />and expansion subject to all of the following being met: <br />1. Auto salvage operation is phased out within three years. <br />2. The east end of Woodlyn Avenue is improved to include <br />paving, curbing and installation of a cul -de -sac subject to <br />City Engineer review. <br />3. City parking, landscaping, paving and curbing, and screening <br />performance standards are met. <br />4. A 50 foot wide street access from Woodlyn Avenue to the <br />proposed southern lot shall be gained via a shared road <br />easement along the west property line (30 feet) of R & S and <br />along the east property line (20 feet) of Empire Rebar. <br />5. Applicant's property must be cleaned up; all debris shall be <br />removed. <br />6. Municipal services shall serve all existing and new <br />buildings on site when available. <br />7. A detailed grading and drainage plan shall be submitted. <br />Plan shall illustrate grading and drainage for the entire <br />area. <br />8. Landscape Plan. <br />Page 31 <br />
