place of residence; such animal shall not be permitted to come <br />in contact with other animals or persons, and the animal be <br />muzzled and on a leash not to exceed four (4) feet when taken <br />from the place of confinement. <br />(B) If no proof of a current rabies vaccination is <br />provided, or upon decision of the owner or an animal control <br />officer, said animal will be quarantined at the Animal Shelter <br />or a licensed veterinary clinic for the term of the quarantine, <br />at the expense of the owner in advance. <br />(C) Said animal shall not be removed from the place of <br />quarantine without written permission from the City Council or <br />an animal control officer. <br />(D) Said animal shall be confined in an enclosure of <br />suitable material which shall not permit the animal to get <br />through, have a secure cover so as to prevent said animal from <br />climbing over, and flooring of concrete and fencing buried at <br />least three (3) feet into the ground so as to prevent said <br />animal from digging out. All openings shall be locked at all <br />times and the animal shall not be removed from said enclosure <br />unless on a leash not exceeding four (4) feet and held by a <br />competent person and muzzled. <br />Section 1101.180. HEARING PROCEDURE. <br />(A) The animal control officers authorized by the City of <br />Little Canada to enforce this ordinance shall have initial <br />authority to determine whether a dog is a dangerous dog or a <br />vicious dog. If an animal control officer determines that a dog <br />is a dangerous dog or a vicious dog, the officer shall notify <br />the owner of the dog of this determination in writing or in <br />person. The owner shall be notified of the dates, times, places <br />and parties attacked or bitten. The owner shall be given ten <br />days to request a hearing before the City Council to determine <br />the disposition of the dog. <br />(B) If no hearing is requested, an animal control officer <br />shall take said animal into custody for disposition. The owner <br />of said animal must make said animal available to an animal <br />control officer upon request. Disposition cost shall be paid by <br />the owner. <br />(C) The City Council shall hold a hearing if requested by <br />the owner. All records of the agents of the City shall be <br />admissible. At the conclusion of the hearing, the City Council <br />shall conclude one of the following: <br />(1) That the dog is either a dangerous or vicious dog; <br />(2) That the dog is a dangerous dog; or <br />Page 13 <br />
