(3) That the dog is a vicious dog. <br />If the City Council determines that the dog is a dangerous dog, <br />the dog shall be confined as set forth in 1101.170. If the City <br />Council determines that the dog is a vicious dog, the dog shall <br />be painlessly killed. <br />Section 1101.190. ADDITIONAL FEE AND PROOF OF INSURANCE AS <br />TO DANGEROUS DOGS. The owner of a dog found to be a dangerous <br />dog by the City Council shall pay an annual $25.00 additional <br />license fee and furnish to the City Clerk, annually, proof of <br />premises liability insurance in the sum of $300,000.00 or more. <br />Section 1101.200. CLEANING UP LITTER. <br />(A) The owner of any dog or cat or any person having the <br />custody or control of any dog or cat shall be responsible for <br />cleaning up any feces of the animal and disposing of such feces <br />in a sanitary manner. <br />(B) It is unlawful for any person owning, keeping or <br />harboring a dog or cat to cause or permit said dog to be on <br />property, public or private, not owned or possessed by such <br />person without having in his /her immediate possession a device <br />for the removal of feces and depository for the transmission of <br />excrement to a proper receptacle located on the property owned <br />or possessed by such person. <br />(C) It is unlawful for any person in control of, causing <br />or permitting any dog or cat to be on any property, public or <br />private, not owned or possessed by such person to fail to remove <br />feces left by such dog to a proper receptacle located on <br />property owned or possessed by such person. <br />(D) The provisions of this section shall not apply to the <br />ownership or use of seeing eye dogs by blind persons, dogs when <br />used in police activities by the city, or tracking dogs when <br />used by or with the permission of the city. <br />Section 1101.210. PENALTY FOR VIOLATION OF THIS CHAPTER. <br />Any person in violation of any of the provisions of this chapter <br />shall be guilty of a misdemeanor. Each day on which such <br />violation continues shall constitute a separate offense. <br />Section 2. <br />This Ordinance shall take effect and be enforced from and <br />after its passage and publication. <br />Page 14 <br />
