I understand that <br />Mr. Lamotte has seven outstanding traffic warrants, including a <br />bench warrant for careless driving. Mr. Lamotte's criminal <br />history includes D.W.I., worthless check, careless driving and <br />miscellaneous traffic offenses. You asked our office to <br />determine whether Mr. Lamotte's criminal history precludes him <br />from obtaining an auto repair license from the City Council. <br />After researching this question, we believe that Mr. Lamotte's <br />criminal history does not affect his license application. <br />Minn. Stat. §346.03 states, in part, as follows: " <br />no person shall be disqualified . from pursuing, practicing, <br />or engaging in any occupation for which a license is required <br />solely or in part because of a prior conviction of a crime or <br />crimes, unless the crime or crimes for which convicted directly <br />relate to . . . the occupation for which the license is <br />sought." In determining whether the conviction directly relates <br />to the requested occupation, the licensing authority must <br />consider: <br />1) The nature and seriousness of the <br />crimes; <br />2) The relationship of the crimes to <br />the reasons for regulating the <br />occupation for which the license <br />is sought; and <br />3) The relationship of the crimes to the <br />fitness required to perform the duties <br />of the occupation <br />Page 15 <br />
