MINUTES <br />Planning Commission <br />Jan. 14, 1988 <br />Bank Shot <br />Billiards <br />Herkenhoff reported that he has had many citizens express concern <br />about recent Planning Commission and Council actions in approving <br />a conditional use permit for Bank Shot Billiards to operate a pool <br />hall within the City. <br />Timmons stated that she was surprised that this conditional use permit <br />was approved and that the Council approved a closing time of 4 A.M. <br />for the pool hall. <br />Davison pointed out that the Commission discussed the closing time and <br />made a recommendation for a closing time of 2 A.M. <br />Herkenhoff stated that he would like to request that the Council review <br />the conditional use permit in view of the complaints that he has received. <br />DeLonais stated that it was his understanding that if the Council deviates <br />from the recommendation of the Planning Commission, the matter must be <br />returned to the Commission for further review. <br />Timmons asked about the City's curfew laws pointing out that Roseville <br />has a curfew of 10 P.M. for children up to 16 years of age and children <br />16 to 18 have a curfew of Midnight. The curfew is strictly enforced in <br />Roseville. <br />Costa stated that he thought there was a 9 P.M. curfew for children <br />under 16 in Little Canada and noted that the City's fire siren used <br />to sound at 9 P.M. for this reason. <br />Timmons reported that Roseville enacted this curfew to try to control <br />vandalism within the City. Timmons was concerned that the City would <br />attract Roseville children to the pool hall after 10 P.M. <br />Timmons felt the City should enact a curfew similar to what Roseville <br />has and that such a curfew should be enforced. <br />Costa suggested that the Commission ask the Council to reconsider the <br />closing time for Bank Shot Billiards. <br />Herkenhoff read the Council minutes at which the Council approved the <br />CUP for Bank Shot Billiards. <br />Herkenhoff suggested that a closing time of 1 A.M. be set for the <br />pool hall. <br />Timmons felt the City had a responsibility to its neighbors and was <br />concerned that properties on the other side of Rice Street were not <br />notified that the City was considering the location of a pool hall <br />on Rice Street. <br />The City Planner reported that properties within 350 feet of the <br />proposed use would be notified of any public hearings. <br />Page 9 <br />
