MINUTES <br />Planning Commission <br />Jan. 14, 1988 <br />Bank Shot <br />Billiards <br />(Cont.) <br />a <br />Davison pointed out that the Planning Commission discussed the fact <br />that the CUP was renewable annually. The Commission also discussed <br />the closing time and determined that a 2 A.M. closing time was <br />preferable until such time as the pool hall demonstrated that there <br />were no problems with the operation. However, Davison stated that <br />if there are any problems at the pool hall, he would be in favor of <br />shutting the operation down. <br />Timmons stated that no child had any business being out until 4 A.M. <br />The Planner replied that the owner of the pool hall will say that they <br />are not trying to attract this age group at that particular time. <br />Timmons was concerned that the pool hall will attract children and was <br />concerned with children hanging around in the pool hall and getting <br />into trouble. <br />DeLonais recommended that the Council reconsider the closing time of <br />Bank Shot Billiards which was approved for 4 A.M. and that the Council <br />set a closing time of 1 A.M. in view of the complaints and feedback <br />the Commission members have received from the general public. <br />Motion seconded by Herkenhoff. <br />Motion carried 6 - 0. <br />Davison questioned the Commission's right to try to ensure that certain <br />moral standards are maintained in the City. <br />DeLonais pointed out that if certain uses are allowed under the Zoning <br />Ordinance, requests cannot be denied if they meet the requirements of <br />the ordinance. <br />Timmons pointed out that the ordinance also states that liquor establish- <br />ments cannot be within so many feet of a school. Timmons felt this was <br />a moral issue and that pool halls fell into the same area. <br />Timmons recommended that the City enact a similar curfew ordinance as <br />the one in effect in Roseville which states that children up to the <br />age of 16 have a 10 P.M. curfew and children between 16 and 18 have <br />a Midnight curfew, and that this ordinance be posted at Bank Shot <br />Billiards and when such an ordinance is passed, that a notice be sent <br />in the sewer bills notifying residents of the curfew. <br />Motion seconded by Herkenhoff. <br />Motion carried 6 - 0. <br />The Planning Commission discussed the number of video games approved <br />for Bank Shot Billiards, and felt that these video games will attract <br />Page 10 <br />
