PLANNING REPORT <br />TO: <br />FROM: <br />DATE: <br />RE: <br />FILE NO: <br />northwest Essociated consultants, inc. <br />Little Canada Planning Commission <br />Michelle Hren /Stephen Grittman <br />28 September 1987 <br />OCT 6 1981 <br />CITY OF <br />LITTLE CANADA <br />Warren Fritze - Little Canada - Second Accessory Building <br />CUP <br />758.09 - 87.55 <br />BACKGROUND <br />Mr. Warren Fritze of 2573 Spruce Street in Little Canada has submitted an applica- <br />tion for a conditional use permit to construct a 20 feet by 35 feet or 700 square <br />foot second accessory building. This building is proposed to be, located in the <br />rear yard of the lot cut into a side hill slope for the purpose of restoring <br />vintage cars as a hobby. The property is zoned R -1, Single Family Residential <br />District and legally described as Lots 1 -5, Block 9 North Heights. Please refer <br />to attachments. <br />ISSUES AND ANALYSIS <br />A conditional use permit is required for a second accessory building pursuant to <br />Section 903.020.D.5., where it states that no building permit shall be issued for <br />the construction of more than one (1) detached or attached private garage for each <br />single family dwelling, except by conditional use permit. This proposed building is <br />actually the first detached garage, therefore, making it a second garage or accessory <br />building which requires a CUP. It should be noted that the CUP request is for a <br />private garage and not for commercial use. Commercial uses are not permitted in <br />R -1 zones. Additionally, the storage of cars outside the garage is highly dis- <br />couraged and would be a condition of CUP approval. The applicant is intending <br />to utilize the proposed garage as a place to work on vintage cars as a hobby. <br />The building must meet all lot requirements as outlined in Section 903.020.D.3 <br />where it states that accessory buildings shall not exceed 15 feet in height, shall <br />be six (6) feet or more from any other building or structure on the same lot and <br />shall not be located within a public drainage, utility, or access easement.
