— (rNUTES
City Council
Dec. 30, 1987
Bank Shot
Billiards
(Cont.)
Fahey felt the comments made by Mr. Townsley addressed policing. Fahey
pointed out that the proposal meets Code requirements and noted that
the center had its own separate entrance. Fahey commented that the
City wants to make sure the operation is a clean one, and noted that
the Sheriff's Department will police the site and report to the City
if there are any problems. Fahey suggested that the Developer's
Agreement give the City the ability to restrict hours of operation
upon notice of a hearing to the applicant.
Blesener noted the lengthy discussions that the Council has had on
billiard centers. Blesener also commented that he felt the billiard
center would be far enough from the Iona Lane residents so as not to
bother them. However, the Council can contact the residents after a
period of time to determine of there are any problems.
Townsley asked if the residents of Iona Lane would receive a notice
of hearing regarding the billiard center.
Fahey pointed out that generally the City operates on a complaint basis.
Townsley reported that he has complained twice to the City about trash
from the shopping center site blowing onto his property and nothing was
done.
Fahey instructed the City Clerk to inform the Building Inspector to
look into this complaint.
Blesener commented that the proposal before the Council fits into the
criteria established by the Council for a billiard center.
Mr. Blesener introduced the following resolution and moved its adoption:
RESOLUTION NO. 87 -12 -582 - APPROVING THE
CONDITIONAL USE PERMIT REQUESTED BY BANK
SHOT BILLIARDS SUBJECT TO THE RECOMMENDATIONS
OF THE CITY PLANNER AS CONTAINED IN HIS DECEMBER
3, 1987 REPORT EXCEPTING THAT A MAXIMUM OF 8
AMUSEMENT DEVICES WILL BE ALLOWED ON THE PREMISES
AND SETTING THE HOURS OF OPERATION AT BETWEEN
8 A.M. AND 4 A.M. WHICH WILL BE SUBJECT TO REVIEW
120 DAYS FROM THE DATE OF OPENING OF THIS BUSINESS,
AND, IF NECESSARY, THE HOURS WILL BE AMENDED AT THAT
TIME
The foregoing resolution was duly seconded by Mr. LaValle.
Ayes (4) Blesener, LaValle, Collova, Fahey.
Nays (1) Scalze.
Resolution declared adopted.
This resolution appears in Resolution Book No. 18, Page 630 and 631.
Page 36
4
