MINUTES <br />Planning Commission <br />Jan. 14, 1988 <br />would feel more comfortable with the issues of ponding being addressed <br />as well as knowing Larry Lee's plans for the development of the <br />property he is buying. <br />Felix reported that Gardner Bros. has an agreement with Larry Lee <br />that if necessary, ponding could straddle the property line. Felix <br />reported that Gardner Bros.' engineer does not feel ponding will <br />be necessary, but Gardner Bros. is willing to provide ponding if <br />necessary. <br />Timmons suggested that the City might want to see the agreement between <br />Larry Lee and Gardner Bros. regarding ponding in writing. <br />The City Planner suggested that the Commission could either deny the <br />lot split request or could act on it conditionally, identifying the <br />issues that needed to be addressed. <br />Davison felt that if the soils of the property are unsuitable for <br />building, this was the risk to the person buying the property. <br />Davison stated that the City does not guarantee the buildability of <br />property. Davison also pointed out that the soils will determine <br />the value of the land. Davison pointed out that the Planner has <br />indicated in his report that there is some buildable area in the parcel. <br />Timmons agreed, but pointed out that there are a lot of questions that <br />need to be answered. Timmons stated that she had concerns whether <br />there was enough buildable area in the site so that it could be <br />developed without a lot of variances being requested as well as fill <br />permits. Timmons was also concerned about the ponding and drainage. <br />Herkenhoff suggested that the lot split be tableduntil the Commission <br />has additional information. <br />Felix requested that the Commission act on the lot split conditionally. <br />Timmons also stated that she would like to know how Larry Lee intends <br />to develop the site. Timmons stated that the Commission needs the <br />City Engineer's report on drainage and ponding, as well as how much <br />area of the site is buildable. <br />Davison agreed that this information was necessary, however, was not <br />comfortable denying the lot split at this point. <br />Costa questioned the fact that Larry Lee has complained about the <br />soils in this area and now he is purchasing additional property here. <br />Felix questioned that a lot split could not be approved until all <br />the details were known. <br />DeLonais pointed out that the Commission must know if there is enough <br />land to build on. How everLarry Lee plans to develop the property <br />is fine as long as the development meets City Code requirements. <br />Page 4 <br />
