MINUTES <br />Planning Commission <br />Jan. 14, 1988 <br />Gardner Costa questioned the legality of this. <br />Bros. (Cont.) <br />The Planner replied that this situation was acceptable as long as <br />Gardner Bros. was aware that they could not build within this 45 foot <br />easement area. <br />Heller replied that Gardner Bros. is aware of this. <br />Timmons felt the Commission needed some indication that the property <br />Gardner Bros. wants to split off is buildable. Timmons asked what <br />percentage of that site was buildable. Timmons also pointed out that <br />there are ponding questions on this site that have not been addressed. <br />Heller replied that there is buildable area in the site and that it <br />is his understanding that Larry Lee wants to build about an 80 foot <br />by 100 foot office warehouse building on the site. The proposal would <br />include ponding as well. <br />Costa asked Gardner Bros. plans for development of their parcel. <br />Felix stated that he could not understand why these two issues were <br />being intertwined. Felix also could not understand why a property <br />owner was not allowed to divide and sell a portion of his property. <br />Felix felt it was up to the purchaser to justify his development <br />proposal. <br />Timmons pointed out that if the City creates a lot it is giving the <br />implication that the property is buildable. <br />Felix disagreed. <br />The City Planner agreed that once a lot is created, there is the <br />assumption that it is buildable. <br />Costa asked how much of the remaining Gardner Bros. site would be <br />buildable. <br />Felix stated that Gardner Bros. does not consider the two issues <br />linked. However, Felix presented the Commission with a concept plan <br />of how Gardner Bros. would develop their remaining 5 acres. Their <br />proposal is for 2 to 3 buildings on the site. Parking would be <br />located under the power line area and there is the thought for some <br />type of office storage on the back portion of the property which also <br />has buildable area. Felix presented the Commission with a concept <br />drawing of the first building that Gardner Bros. would build, which <br />Felix described as a very attractive structure which would have a <br />brick face. <br />Timmons explained to Felix that the Commission must consider the <br />entire piece of property at this point. Timmons also pointed out <br />that ponding must be addressed. Timmons stated that the Commission <br />is not saying that the property cannot be divided, but the Commission <br />Page 3 <br />
