MINUTES <br />Planning Commission <br />February 11, 1988 <br />Frank Schultz also stated that he did not consider the broken up blacktop <br />Frattalone that Frattalone put on the site as paving, although it is better than <br />CUP having dust blow around. <br />(Cont.) <br />Schultz strongly urged the Commission not to approve the Frattalone <br />request and follow the Council direction to bring the property into <br />conformance. Schultz stated that the Council has made a clear commitment <br />in the past to the people in this area. <br />Schultz also reported that due to the condition of the Frattalone <br />property, he has received a tax abatement for his property. Schultz <br />reported that Park Street is not developing due to the condition of <br />the Frattalone property and the City is losing tax base. <br />DeLonais asked what was wrong with approving an inside storage use <br />for this building. <br />Schultz stated that he was not in favor of any proposal that was <br />non - conforming. <br />The Planner reported that the property is zoned 8 -3 and inside storage <br />is a conditional use which means it is allowed in this zone. However, <br />it does require the review of the Planning Commission and City Council. <br />Schultz felt Frattalone was not giving all the information. <br />The Planner reported that a conditional use permit cannot be granted <br />for a non - conforming use. The lawn service and auto body uses are <br />non - conforming uses. However, storage is a conditional use that <br />requires Council and Commission review. One condition of storage is <br />that it be totally screened, and since this storage is inside storage, <br />that requirement is met. The request before the Commission meets zoning <br />requirements and the City can act upon it. It is not a non - conforming <br />use. <br />Schultz asked if sprinkler manufacturing was a permitted use. <br />Timmons stated that she understood Schultz's concerns, however, listed <br />the permitted uses in a 8 -3 district which might be more objectionable <br />than indoor storage. Timmons pointed out that inside storage is a <br />permitted use in a 8 -3 with a conditional use permit. <br />Schultz pointed out that the Commission and Council can judge whether <br />it is a proper use. Schultz did not believe that the operation would <br />be strictly storage, especially if the headquarters moves into this <br />building <br />The Planner noted that office or plumbing sales and repairs are permitted <br />uses in B -3, and if the sprinkler firm was coming in requesting to locate <br />their office in the building, a CUP would not be necessary, and then <br />the storage would be an accessory use.
