February 5, 1988 <br />Page Two <br />One condition of the variance approval which was granted is that the City <br />Council is to review the placement of the house the applicant plans to <br />construct prior to the issuance of a building permit for the property. <br />This is to preclude the possibility of a further lot split in the future <br />for the site. No site plan for lot one has been submitted to date. Staff <br />recommends further City review of this matter when a building permit is applied <br />for. <br />The proposed plan shows a thirty foot strip serving as a private driveway <br />accessing only lot one. A condition of the variance approval for this property <br />was that the driveway easement is to be improved with a dust -free material. <br />Staff recommends the improvement of the easement to meet this requirement <br />prior to the issuance of the building permit. This is to ensure that the <br />neighboring homes are given the most protection reasonably possible from <br />driveway dust during the construction of the single family home behind them. <br />It should also be noted that the City Engineer has waived his review of the <br />topographic conditions on the site at this time. Specific grading details <br />and utility connections should be reviewed by City Staff prior to issuing a <br />building permit. <br />RECOMMENDATION <br />Based on the unique situation and circumstances of the property involved <br />and the variance request which was granted earlier, it is our office's <br />opinion that proposed subdivision plan offers an opportunity to resolve <br />many long standing issues for this area. We recommend approval of the <br />subdivision request as shown in Exhibit A of this report and that it be con- <br />ditioned upon: <br />1. That prior to the issuance of a building permit for the Leibel property, <br />a site plan be submitted for Staff and Planning Commission review and <br />be subject to City Council approval. <br />2. That future divisions of the property in question not be considered by <br />the City. <br />3. That prior to the issuance of a building permit for the Leibel property, <br />the driveway easement be improved with a dust free material. <br />4.
