MINUTES <br />Planning Commission <br />March 10, 1988 <br />Gardner <br />Bros. <br />(Cont.) <br />DeLonais recommended concept approval of the Gardner Bros. PUD <br />and preliminary plat subject to compliance with the recommendations <br />of the City Planner. <br />Motion seconded by Davison. <br />Motion carried 6 - 0. <br />Foyt Mr. Chris Berndt, attorney representing Mr. and Mrs. Rindeloff, <br />Property appeared before the Commission requesting approval of a property <br />Division division and variance so that a portion of the Foyt property could <br />be divided and combined with the Rindeloff property. The Rindeloff <br />home would then be less than one foot from the property line, and <br />a sideyard setback variance would be necessary. <br />The Planner explained that the City previously granted Mr. and Mrs. <br />Foyt a variance to locate their home further to the north provided <br />that the property owners to the north were agreeable with the variance. <br />However, the property owners to the north were not agreeable, and, <br />therefore, the Foyt's have no variance approval at this time. <br />The Planner reported that he has not heard from the Foyt's, but he <br />thought they were going to ask for a less than 20 foot building <br />separation on the south. However, the Planner stated that he has <br />seen no application for this. <br />Berndt stated that the Foyt's and Rindeloff's have submitted a joint <br />application covering the property division as well as sideyard setback <br />variances for both properties from the shared property line. <br />The Planner reported that he has not seen this application, and <br />pointed out that public hearings are necessary on the variance <br />requests. <br />The Planner also reported that he has had conversations with the <br />Foyt's attorney who has just recently taken over the matter. <br />Berndt pointed out that there is litigation involved in this matter. <br />Berndt again stated that there is a jointly executed application <br />for the lot split and variances. <br />The Planner stated that concurrent variances will need to be granted <br />in the matter. The Planner also reported that he needs to see the <br />application and also needs the legal description of the piece of <br />property that is being conveyed to the Rindeloff's. <br />DeLonais suggested that the matter be tabled at this point and <br />instructed Mr. Berndt to work with the City Planner. <br />Page 7 <br />
