PLANNING REPORT <br />northwest associated consultants, inc. <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 5 April 1988 <br />RE: Foyt /Rindelaub Building Encroachment - Subdivision <br />FILE N0: 758.09 - 87.64 <br />BACKGROUND <br />The Foyts and the Rindelaubs have applied for a subdivision of the Foyt's property <br />on Reidmond Avenue. The proposal would split a ten foot by 65 foot strip of land <br />from the Foyt's lot and add it to the Rindelaub's lot. Currently, the Rindelaub's <br />house encroaches 9.1 feet onto the Foyt's property. The subdivision would result <br />in a side yard setback of 0.9 feet. The Rindelaubs have further asked for a side <br />yard setback variance to allow this encroachment. This process is separate from <br />previous requests by the Foyts to allow side yard setback variances on their lot. <br />ANALYSIS <br />Exhibit A illustrates the proposed subdivision and side yard setback variance request. <br />The City had previously indicated that a six foot building separation was acceptable <br />between the Rindelaub's garage the the Foyt's eventual house. The basis for the six <br />foot separation is that the State Fire Code requires this distance as a minimum, as <br />defined by building type. Our original indication to the City was that if the six <br />foot separation was acceptable, the property line should split the area evenly with <br />a three foot setback on each side. <br />Such an arrangement would require an additional 2.1 feet of property be split from <br />the Foyts and added to the Rindelabus, for a total subdivided width of 12.1 feet. <br />The rationale for the minimum 3 foot setback is to allow a minimum amount of area <br />for building maintenance. With a 0.9 foot setback, maintenance on that side of the <br />Rindelaub's house would, as a practical matter, require the use of a small portion <br />of the Foyt's property.
