601.050. ABATEMENT OF NUISANCE BY COUNCIL. If, after such service <br />of notice, the person served fails to abate the nuisance or make the <br />necessary repairs, alterations or changes in accordance with the direction <br />of the Council, the Council may cause such nuisance to be abated at the <br />expense of the Council and recover such expenditure, plus an additional <br />twenty -five (25%) percent of such expenditures, by civil action against <br />the person or persons served; or, if service has been had upon the owner <br />or occupant, by ordering the Clerk to extend such sum, plus twenty -five <br />(25%) percent thereof, as a special tax against the property upon which <br />the nuisance existed and to certify the same to the County Auditor of <br />Ramsey County, Minnesota, for collection in the same manner as taxes and <br />special assessments are certified and collected. <br />601.090. PENALTIES. Any person who shall cause or create a <br />nuisance, or permit any nuisance to be created or placed upon, or to <br />remain upon any premises owned or occupied by him, and any person who <br />shall fail to comply with any order made under the provisions of this <br />Code, upon conviction thereof shall be guilty of a misdemeanor and shall <br />be punished by a fine of not more than Five Hundred Dollars ($500.00) or <br />by imprisonment in the County jail for not more than ninety (90) days. <br />601.100. SEPARABILITY. Every section, provision or part of this <br />Chapter is declared separable from every other section, provision or part; <br />and if any section, provision or part hereof shall be held invalid, it <br />shall not affect any other section, provision or part. <br />(Source: Ord. 29, Amended: Ord. 254) <br />602. PROHIBITION OF CERTAIN OPEN FIRES ON BALCONIES <br />602.010. DECLARATION OF POLICY. The City Council for Little Canada <br />has determined that the increasing popularity of open fire barbecues on <br />apartment building balconies has created new fire hazards which endanger <br />the health and safety of the residents of Little Canada and for which no <br />safety precautions are provided in the existing municipal Code. It is <br />hereby declared to be the intention of the Council to promulgate rules and <br />controls which will effectively prevent tragedies from occuring in <br />multiple dwellings as a result of such activities within Little Canada'sk <br />boundaries. <br />602.020. PROHIBITED BURNING. It shall be unlawful for any person <br />or persons to start, light, keep, burn, maintain or otherwise have an open <br />fire on any balcony of any apartment building for the purpose of <br />barbecuing, cooking or any other recreation purpose unless the burning <br />receptacle is of such a type and design as to absolutely preclude the <br />spilling out of any part of the burning materials, whether wood, charcoal, <br />briquets or other type of fuel, onto the balcony floor or off of the <br />balcony itself. Such receptacle or device shall be attached or affixed to <br />the floor or wall or railing in such a way as to render it incapable of <br />being tipped over or tilted so as to allow the burning contents to be <br />spilled therefrom. In addition, all such receptacles or devices shall be <br />covered sufficiently to prevent the spilling, blowing or drifting of <br />sparks, embers or ashes and shall be equipped with legs at least 10 inches <br />Page 79 <br />
