and City that any costs associated with development of the parcels to the east will not result in <br />assessments levied against any lot located in the development. However, future assessments for <br />maintenance, repair or reconstruction of said improvements may be levied against lots located in <br />the development. <br />36. Developer shall include definitive statements in all sales literature regarding <br />future development of the abutting property to the east. It should be made clear that said <br />abutting property to the east may be developed as additional single family lots. The purpose of <br />these statements is to make prospective buyers aware of likely development in order to minimize <br />objections in the future. <br />37. Developer shall sell to McCumber, abutting owners, Outlot A. The Developer <br />shall sell to Paddock, abutting owners, Outlot B. All revenue generate from said sales shall be <br />deducted from Developer's contributed capital as set forth in Exhibit B attached hereto. <br />Developer shall dedicate to the City an easement for street purposed including but not limited to <br />construction and maintenance of utilities over and across Outlot C. Developer shall convey <br />Outlot D to Gloria Acosta and shall pay all costs incurred in recording said conveyance. <br />38. The Developer shall construct a monument sign at the entry area and shall <br />construct and maintain entry area landscaping as well as landscaping of the pond /circle area. In <br />addition, the Developer shall install an irrigation system to maintain the entry area landscaping <br />as well as the landscaping of the pond /circle area. <br />39. The Developer shall prepare a declaration creating a non -profit association for the <br />purpose of maintaining all entry monuments and associated landscaping as well as pond /circle <br />landscaping and irrigation facilities installed to maintain said landscaping. All lots in the <br />development shall be bound by the Declaration and the owners of said lots shall be members of <br />the Association. The Declaration shall provide for annual assessments to maintain the <br />
