landscaping described above and a special assessment to repair or replace any landscaping or <br />equipment which the City, at the City's sole discretion, requires to be replaced. The Declaration <br />shall be reviewed and approved by the City. <br />40. Each deed conveying title to a lot located in the development shall contain the <br />following covenant: "Grantee hereby acknowledges that Outlot C, Pinetree Ponds has been <br />dedicated to the City of Little Canada for the purpose of constructing future roads and providing <br />water, sewer and utility services. That by accepting this deed, the Grantee hereby waives any <br />right to object to future improvement of Outlot C." <br />41. Developer shall upon execution of the final plat and Development Agreement <br />have the right to apply for and receive all necessary building permits required to commence <br />construction of homes. However, as previously stated, no occupancy permit shall be issued until <br />the first lift of asphalt has been installed. <br />42. Required notices to Developer shall be in writing and shall be either hand <br />delivered or mailed by certified mailto the following address: <br />Masterpiece Homes, Inc. <br />43. Required notices to the City shall be in writing and shall be either hand delivered <br />or mailed by certified mail, in care of the city administrator, to the following address: <br />City of Little Canada <br />515 Little Canada Road East <br />Little Canada, MN 55117 <br />IN WITNESS WHEREOF, the parties have set their hands to this Contract on the date stated <br />above. <br />
