MINUTES CITY COUNCIL JUNE 12, 2013 PINETREE POND DEVELOPMENT AGREEMENT The City Administrator recommended adoption of the ordinance before the Council this evening which repeals the indecent exposure section of the Municipal Code. Keis introduced the following resolution and moved its adoption: RESOLUTION NO. 2013 -6 -100 — ADOPTING AN ORDINANCE AMENDING CHAPTER 1201, DISORDERLY CONDUCT, OF THE LITTLE CANADA CITY CODE, KNOWN AS THE MUNICIPAL CODE, BY REPEALING CHAPTER 1201.020, INDECENT EXPOSURE, IN ITS ENTIRETY AS RECOMMENDED BY CITY STAFF The foregoing resolution was duly seconded by Montour. Ayes (4). Nays (0). Resolution declared adopted. The City Administrator reported that the City Attorney's office has drafted the proposed Development Agreement for Pinetree Pond. The Administrator reviewed his report dated June 7, 2013 outlining the key issues addressed in this agreement. The City Attorney also noted that paragraphs 12 and 13 of the Development Agreement addresses the issues of financial security for the City. Paragraphs 20 through 24 address engineering issues. The City Administrator noted that the Development Agreement follows the City's standard format except that the infrastructure improvements are being installed as a public improvement. The Administrator also indicated that Masterpiece Homes has not yet reviewed the proposed Development Agreement. The Administrator recommended Council approval of the Agreement as proposed with the stipulation that any minor changes resulting from the developer's review would be subject to the City Attorney's approval. Substantive changes would be brought back to the City Council for approval. Montour asked the timing on payment of building permit fees and park charges. The City Administrator reported that the park charge would be collected as part of the building permit. He also reported that the developer would pay the cost of each lot to the City at closing when the title is transferred to the purchaser of the house.
