MINUTES <br />CITY COUNCIL <br />JUNE 12, 2013 <br />PINETREE <br />POND <br />DEVELOPMENT <br />AGREEMENT <br />The City Administrator recommended adoption of the ordinance before <br />the Council this evening which repeals the indecent exposure section of <br />the Municipal Code. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -6 -100 — ADOPTING AN ORDINANCE <br />AMENDING CHAPTER 1201, DISORDERLY CONDUCT, OF THE <br />LITTLE CANADA CITY CODE, KNOWN AS THE MUNICIPAL <br />CODE, BY REPEALING CHAPTER 1201.020, INDECENT <br />EXPOSURE, IN ITS ENTIRETY AS RECOMMENDED BY CITY <br />STAFF <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the City Attorney's office has drafted <br />the proposed Development Agreement for Pinetree Pond. The <br />Administrator reviewed his report dated June 7, 2013 outlining the key <br />issues addressed in this agreement. The City Attorney also noted that <br />paragraphs 12 and 13 of the Development Agreement addresses the issues <br />of financial security for the City. Paragraphs 20 through 24 address <br />engineering issues. The City Administrator noted that the Development <br />Agreement follows the City's standard format except that the <br />infrastructure improvements are being installed as a public improvement. <br />The Administrator also indicated that Masterpiece Homes has not yet <br />reviewed the proposed Development Agreement. The Administrator <br />recommended Council approval of the Agreement as proposed with the <br />stipulation that any minor changes resulting from the developer's review <br />would be subject to the City Attorney's approval. Substantive changes <br />would be brought back to the City Council for approval. <br />Montour asked the timing on payment of building permit fees and park <br />charges. The City Administrator reported that the park charge would be <br />collected as part of the building permit.
