MINUTES <br />CITY COUNCIL <br />JUNE 12, 2013 <br />RESOLUTION NO. 2013 -6 -104 - TEMPORARILY ADJOURNING <br />THE REGULAR COUNCIL MEETING AND CONVENING INTO <br />CLOSED SESSION AS RECOMMENDED BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Blesener reported that following the adjournment of the closed session, the <br />Council will come back into its regular meeting. The City Attorney will <br />then provide a brief report on the closed session and at the conclusion of <br />that report, the regular Council meeting will be adjourned. The broadcast <br />portion of the meeting will end when the Council goes into closed session. <br />The Council went into closed session at 8:21 p.m. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION 2013 -6 -105 - ADJOURNING THE CLOSED SESSION <br />AND RECONVENING THE REGULAR COUNCIL MEETING <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Attorney reported that the time is now 9:13 p.m. and the City <br />Council adjourned out of closed session and reconvened the regular <br />Council meeting. He indicated that there were two topic discussed during <br />the closed session. The first was potential litigation by the Brausen <br />Family and the City Attorney noted that the closed session was allowable <br />based on the Attorney - Client Privilege exception to the Open Meeting <br />Law. The City Attorney indicated that at the closed session the <br />background of the Pinetree Pond plat was discussed as well as the <br />strengths of the City's position. The Attorney indicated that the consensus <br />is that the City is taking a wait -and -see approach at this time. He <br />indicated that his office has reached out to the Brausens' attorney and his <br />office has not yet received a response. <br />The next topic discussed was the possible purchase of property for a new <br />Public Works garage, and the closed session was allowable based on the <br />Purchase of Real Property exception to the Open Meeting Law. At the <br />closed session the City Administrator was authorized to negotiate a <br />purchase price for 2858 Centerville Road. <br />8 <br />
