MINUTES
PLANNING COMMISSION
JANUARY 12, 2006
and noted that reducing the front yard setback to 30 feet does not change the
setback from the lake. Knudsen pointed out that it has been typical to see
redevelopment of lake lots with larger homes. As long as the setback to the
lake is protected, he did not see a concern with reducing the font yard
setback.
Knudsen recommended approval of the Text Amendment to the Shoreland
District reducing the required front yard setback in the Single Family
Zoning District (R-1) to thirty (30) feet for properties abutting a Federal,
State, or County trunk highway.
Motion seconded by Barraclough.
Motion carried 7 - 0.
TEXT Mr. Matt Galba, 2850 Edgerton Sheet, appeared before the Commission
AMENDMENT requesting approval of the following:
& CUP FOR Text Amendment creating a Conditional Use Permit to allow for
RECREATIONAL recreation uses in the front yard;
USE IN FRONT Conditional Use Permit allowing a recreational use (sports court)
YARD AS WELL in the front yard;
AS CUP FOR Conditional Use Permit for two attached garages consisting of over
TWO GARAGES 1,000 square feet in area.
AND GARAGE
SPACE OVER Galba reviewed his plan for a sports court for hockey and basketball for the
1,000 SQUARE use of his children and friends. Galba felt that this sports court was a good
FEET - solution to ensuring his children remain active and healthy as well as a
2850 means to interact with fiā€¢iends.
EDGERTON
STREET - Socha asked if Galba was aware that a permit would be needed for the
MATT GALBA sports court prior to constructing it. Galba replied that he did not. He noted
that he has a very large lot, and felt that he needed to make use of his
property. Hall felt that in planning a sports court like this, it was Galba's
responsibility to first check into the permit process before constructing it.
Galba indicated that there is nothing in the City's Code that says a hockey
rink cannot be located in a front yard. Galba pointed out thaC the rink is
now up and stated that he was willing to work with the City Co make the
rink acceptable.
Knudsen felt that debating the permitting process at this point was not in
anyone's best interest. Knudsen noted that, in this case, the size of the front
yard is unique. He also stated that he completely understands Galba's
desire to make use of his front yard. Knudsen felt that the City now has to
deal with what can happen in the City and what needs to happen. Knudsen
-4-
