NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: David Licht <br />FROM: James Vick <br />DATE: 30 August 1984 <br />RE: Flameburger - Ordinance Enforcement <br />FILE NO: 758.09 - 82.10 <br />Since the Zoning Ordinance performance standards do not require any "special" <br />conditions for the Flameburger, I have consulted the City Council minutes <br />regarding the Flameburger building permit and subdivision. On July 8, 1981, <br />the following resolution was passed: <br />RESOLUTION NO. 81 -7 -334 - APPROVING THE BUILDING PERMIT FOR THE <br />FLAMEBURGER RESTAURANT CONTINGENT UPON: <br />1. Their proper location of sign on Rice Street in accordance with <br />the Planner's report of July 2, 1981. <br />2. Upon their submission and satisfactory review and approval by <br />the City Council of their landscaping and screening plan which <br />should be presented on July 22. <br />3. That the site reading and drainage for the area including <br />their lot be approved by the City Engineer and his review be pre- <br />sented to the City Council for their approval by the July 22nd meeting <br />with the understanding that these recommendations will be given to <br />the developer prior to July 20th for his consideration. <br />4. That there be no excavation, grading or construction pursuant <br />to the building permit until further action by the Council on the <br />July 22nd meeting. <br />Include as part of the building permit two variances for reasons of <br />improving the land use circulation and the figuration of the lot. <br />Allow two driveways with the 134.5 feet street frontage on Demont <br />Avenue rather than the required 250 feet, and also the curb on the <br />west side of the Demont Avenue driveway, as stated in the Planner's <br />report, be allowed to abut the property line rather than meeting the <br />required five feet on the perimeter. This extra driveway will generally <br />improve the traffic within the site. The granting of this valiance <br />would not impair adequate light to property or any other factors <br />mentioned in our ordinance regarding variances. Include the ' <br />recommendation of the planner tha4rthe building permit be contingent <br />upon the successful negotiation o /a bond lease agreement with the <br />abutting land owner concerning use of the driveway.
