Austad, Jr. and David Sandberg regarding their Application
for Special Use Permit to operate an automobile salvage yard at
their business property located at 38 West Woodlyn, St. Paul,
Minnesota.
You have received a copy of James Vick's Planning Report dated
June 7, 1984. Reference is made in said report to my clients'
constructing a building on a road easement. My clients have not
constructed any building on a road easement. I am enclosing a
copy of a Warranty Deed dated December 8, 1978 to my clients for
the parcel of property upon which the City of Little Canada claims
my clients constructed a building on an easement. As of the date
of this Deed, no such easement ever existed and in 1978 my clients
constructed a pole building pursuant to a building permit issued
by the City of Little Canada.
The first reference to any easement arises from a Contract for
Deed dated January 4, 1982, a copy of which I am enclosing.
After you have reviewed Mr. Vick's Planning Report of June 7 and
the enclosed documents, I ask that you call me at my office so
that we can discuss this matter. Thank you.
Respectfully,
DAVID W.
