NORTHWEST ASSOCIATED CONSULTANTS INC.
MEMORANDUM
TO: Little Canada Mayor and City Council
FROM: David Licht
DATE: 19 June 1984
RE: R & S Automotive
FILE NO.: 758.09 - 84.21
At the Planning Commission meeting, R & S's legal counsel claimed that the public
road easement which the City required as part of subdivision and which affects
R & Swas never provided. As a result of this situation, the Planning Commission
tabled any and all action on the R & S conditional use permit application.
We now find ourselves at the point of a dead stop relative to the R & S matter.
To get this matter moving again, an initial step is to have the City Attorney
analyze the apparent failure to provide the easement which was required.
Subsequently he should provide direction as to what action, if any, needs to
be taken to bring about compliance.
It would also appear advisable to me to move ahead on addressing the balance of the
R & S conditional use permit request for expanded outside storage. While holding
necessary conditions open for addressing access in the area, improvement of the
site and operation would seem to be an item on which we could proceed. My basic
fear is that the summer and construction seasons are slowly slipping away.
Should action on site improvement be delayed until resolution of the easement
and area access question, it is likely that nothing will be accomplished until
next year.
Your comments and direction on this matter is requested.
DRL /jto
cc: Joseph Chlebeck
Ed Locke
Don Carley
Tom Sweeney
R & S Automotive
1C
pg:M14)
JUN 20 1984
CITY OF
LITTLE CANADA
4820 minnetonka boulevard, suite 420 minneapolis, mn 55416 612/925-9 -120
