ANIMAL CONTROL SERVICE CONTRACT <br />THIS AGREEMENT, made and entered into this 1st day of January, <br />1985, by and between WHITE BEAR ANIMAL CONTROL, INC., a Minnesota <br />corporation, hereinafter referred to as "WBAC ", and the CITY /TOWN OF <br />LITTLE CANADA, a municipal corporation, Ramsey County, Minnesota, <br />hereinafter referred to, as "CITY /TOWN ". <br />WITNESSETH: That WBAC, in consideration of the covenants and <br />agreements of CITY /TOWN hereinafter contained, hereby covenants with <br />CITY /TOWN that WBAC will provide Animal Control Service to CITY /TOWN <br />pursuant to the following provisions:. <br />1. That WBAC shall provide pick up service of <br />animal in CITY /TOWN in a vehicle appropriate for <br />the transportation of small animals. On -call <br />pick up service shall be provided Monday through <br />Friday, 8:00 a.m. to 10:00 p.m., and Saturday, <br />Sunday and holidays, 8:00'a.m. to 12:00 noon. <br />Standby emergency service shall be provided on a <br />twenty -four (24) hour basis at the specific <br />request of CITY /TOWN's law enforcement agency <br />and /or previously specified official of <br />CITY /TOWN. <br />2. That patrolling shall be performed by competant <br />WBAC personnel trained in the handling of <br />animals. That such personnel shall be subject to <br />approval by CITY /TOWN at CITY /TOWN'S request. <br />3. That WBAC shall equip, service and maintain all <br />vehicles used for Animal Control Service with <br />two -way radios or other communication <br />equipment. <br />4. Pursuant to Minnesota Statute 35.71 WBAC shall <br />impound all animals picked up in CITY /TOWN at <br />its Animal Shelter located at 1281 Hammond Road, <br />Town of White Bear (Township), Minnesota. Said <br />animal shall be confined in a humane manner for <br />a period of not less than five (5) business days <br />or until claimed by an owner. Animals not <br />claimed before the expiration of five (5) <br />business days shall become the property of WBAC. <br />If an animal is not so claimed, WBAC may <br />dispose of said animal in a humane manner, <br />pursuant to Minnesota Statute Section 35.71, <br />Subd. 3. <br />5. That an impoundment fee of $25.00 per animal <br />shall be retained by WBAC. <br />6. That WBAC shall provide euthanasia service to <br />CITY /TOWN at no additional charge.
