S. 6286 (I 694) <br />This letter is in response to City Resolution No. 84 -4 -161 dated April 11, 1984, <br />and the residents petition requesting noise walls. <br />The subject area of I -694 is not unique in terms of perceived need for noise abatement. <br />Through the Metropolitan area much development has occurred adjacent to Interstate <br />facilities creating similar situations. <br />As you know, in the mid -70's over 20 miles of noise walls were constructed on already <br />opened Interstate routes in response to Legislative authorization. Some of these are <br />in Little Canada; example is I -35E north of Trunk Highway 36 on the east side. However, <br />in 1978 the Minnesota Legislature placed a moratorium on construction of any additional <br />acoustical barriers on or along already completed Interstate highways. <br />In addition, the issue is more complex in the case of Twin Lakes Shores because the <br />development has occurred after the road was inplace. In 1976, Federal policy declared <br />noise abatement to be ineligible for the use of federal transportation dollars where <br />development occurred after the fact. Our State policy reflects this position. In fact <br />in our February 16, 1979 review of the Twin Lake Shores plat we identified the potential <br />noise impacts to this type of land use. <br />Clearly, what is inherent in these Federal and State policies is an obligation by developers <br />and local governments to insure compatibility between land use and transportation corridors. <br />In summary, there is not an existing program that will provide any noise abatement for <br />development after the fact. <br />Sincerely, <br />Kermit K.
