It was directed that a more detailed site plan be prepared and <br />submitted, as well as that the applicant and Planner's office work to <br />resolve issues if at all possible. Additionally, comments from the <br />public hearing were desired. (One neighbor was in attendance with no <br />comment to offer.) <br />At the public hearing, Council member Scalze also noted a discrepancy <br />between the City's plat map and the site survey of the applicant. At issue <br />is a triangular parcel of City owned land extending eatward from Centerville <br />Road (see attached zoning map for location). The City plat map indicates <br />that Mr. Kimmes' lots may not extend all the way to the Water Department <br />land. If this is the case, the building setback of the large commercial <br />structure is in.question. The City Engineer was directed by the Council to <br />clarify this matter. While this natter is of general concern and should <br />be resolved, it is our opinion that it does not affect the specific applica- <br />tion at hand. <br />REQUEST ANALYSIS <br />In compliance with the Planning Commission's directives, the applicant has <br />submitted a more detailed site plan which is attached along with the plan <br />for the proposed building. <br />In our office's negotiations with the applicant, it has been agreed that a <br />future combination of the two parcels into one is an acceptable and preferred <br />situation. Due to financing considerations, it would be difficult to achieve <br />this combination at this time. NoWever, Mr. Kimmes did agree to sign a <br />recordable PUD Agreement indicating that the parcels would be considered <br />and treated as one parcel in the future and that when present financing <br />constraints lapse, the combination would in fact take place. <br />93 <br />4820 minnetonka boulevard, suite 420 minneapolis, mn 55416 612/925-9420 <br />
