Little Canada Mayor and City Council <br />Little Canada Planning Commission <br />2 May 1984 <br />Page Two <br />It was also agreed that the two existing residential structures would <br />continue to be treated and classified as legal nonconforming uses and <br />buildings. As such, if they were distroyed or damaged to an extent equal <br />to 50 percent or more of their value, they could not be replaced. Further- <br />more, the two residential structures could not be altered in use in any <br />fashion without Council approval and PUD amendment. <br />The only other stipulation which we would suggest is a modification of <br />parking immediately adjacent to Little Canada Road. This matter has been <br />discussed generally with Mr. Kimmes, but at the time of this report, the <br />proposals have not been discussed in detail with him. <br />The parking proposal which we would offer is that at minimum, the two <br />easterly spaces for the triplex be oriented into the driveway and not the <br />street (see Attachment D). If an agreement can be reached with the <br />neighbor to the west, a similar arrangement should be implemented for <br />the two westerly parking spaces. <br />Drainage questions have been referred to the City Engineer for comment. <br />RECOMMENDATION <br />Given the above considerations, we believe the increased inside storage <br />is of benefit to the area in which the property is located. Also, the <br />proposed use restrictions offer the City a long term resolution of sub- <br />standard sized lot development and work toward an eventual improvement of <br />the sites in question and area as a whole. Based upon these factors and <br />opinions, we recommend approval of the PUD rezoning request subject to the <br />following: <br />1. Entering into a PUD agreement which stipulates: <br />a. The parcels are hereinafter to be treated as one lot and when <br />present financial limitations are eliminated, action is taken <br />to formally combine the parcels (a registered land survey and <br />appropriate papers are to be prepared at this time and made <br />part of the PUD agreement.) <br />b. The two residential structures are to be treated and governed <br />as legal nonconforming uses. These structures are not to be <br />altered in size or use without City Council approval and formal <br />PUD amendment. <br />94 <br />
