Little Canada Planning Commission <br />5 January 1984 Page Two <br />923.010.3. To allow variation from the provisions of this Ordinance <br />including setbacks, height, lot area, width and depth, yards, <br />etc. <br />This procedure will provide for a zero lot line situation, in effect eliminat- <br />ing the interior side yard setback. <br />We believe that the proposal meets these goals. The City is in no way <br />adversely impacted by the subdivision of this parcel. Densities, housing <br />type, lot configuration, and the impacts on City provided services will all <br />remain the same as they now exist. <br />The following requirements are made of PUD proposals in Zoning Ordinance <br />Section 923.020: <br />A. Application must be made by the landowner. <br />B. PUD must be consistent with the Comprehensive Plan. <br />C. PUD must be consistent with the City Sewer Plan. <br />D. PUD must provide common open space. <br />E. Maintenance of common open space must be provided for through City <br />dedication or Property Owner's Association. <br />F. Open space must be proportionately provided through all stages. <br />G. Density must agree with Comprehensive Plan. <br />H. All new utilities must be installed underground. <br />I. Utility connections must be separately metered. <br />J. New streets must conform to City standards. <br />K. Landscaping must be provided. <br />L. Development must occur at timing consistent with planned City <br />service extensions. <br />M. Regulates condominium type development. <br />N. Waives all interior setback lines. <br />The Buechler proposal meets all of the requirements of this section which are <br />applicable with the exception of subsection D. requiring the provision of <br />common open space. We do not feel this proposal should be held to this pro- <br />vision since each unit will have substantial private open space. This restric- <br />tion is generally included because PUD units often lack private open space. <br />RECOMMENDATION <br />It is recommended that the conditional use permit for a planned unit develop- <br />ment and subdivision be approved. It should be noted, however, that this <br />memorandum has been written without the benefit of site plans of the subject <br />property, and thus our recommendation is understood to be contingent upon the <br />sufficient and appropriate submissions by the applicant. The applicant has <br />indicated that such plans shall be available before the Planning Commission's <br />regular meeting of 12 January 1984. This office will supply the Commissioners <br />with copies of these plans at the meeting. <br />10 <br />
