I think there <br />are a number of items listed under Section C - Performance Standards <br />which are legally questionable. Item No. 5 indicates owners of the <br />residence in which the accessory unit is created shall occupy at least <br />one of the dwelling units on the premises, except for temporary absence. <br />My impression would be that this section could be challenged in that <br />an owner occupancy is demanded as part of the ordinance. <br />Item No. 6 also goes back to the 10% issue and the definition of a block. <br />Again, I am questioning whether this is to arbitrary of a limitation to <br />be imposed.
